Just had a conversation with Rockwells (M&S, Enforceable) they want me to increase monthly payments, which I can't do at the moment.

The lady on the phone asked if I could look at gettinga lump sum from somewhere. I asked where - she said friends/family, or how about extending a loan or putting it on another credit card. I challenged this and said I thought that they were breaching OFT guidelines by suggesting this.

She said it was only their suggestion, as sometimes people find it useful to be able eg if they have a 0% credit card!!! (Yep as if I had lots of them stuffed up my sleeve, no-one's going to offer me any sort of card at the mo, least of all a 0% one!!).

Well I don't know whether to make a meal of this and complain to the OFT. Muppets.

    Hiya

    Naughty Rockwells

Not allowed to do that, excerpt from OFT guidance on debt collection:-

2.6 Examples of unfair practices are as follows:
    b. pressurising debtors to sell property, to raise funds by further
borrowing or to extend their borrowing

    f. pressurising debtors to pay in full, in unreasonably large instalments,
or to increase payments when they are unable to do so

      Cheers Swanny

I did read them the OFT Guidelines - I was sitting in front of hte computer and had looked them up. The lady I spoke to was completely unfazed and said it was just a suggestion! So, I guess they reckon that if they just suggest it, rather than insist on it, they reckon they are compyling. Interesting interpretation isn't it!

I am sorely tempted to tell the OFT.

        They shouldn't even "suggest" it

Absolutely! What a ridiculous getout, that it was OK because it was only a suggestion!

I think I shall take it up with the OFT. Will they do anyting about it though, do you think?

              Mmm. I want a Truecall!
If I ever spoke to them by phone again (and I'm not, I'm going to stick to writing letters), I'll tell them at the outset that I'm recording to the conversation.

But I think I might just draft a letter to them saying I can't increase payments and that I was concerned that they are asking me if I have a credit card or loan I could put a lump sum on... Just so I have it in writing
