    Under £3k was owed to Cap 1. It must be or shall be SB imminently. A dodgy default notice was issued. Account assigned to Cabot. My CCA request was received by Cabot on 14th Jan. Am still waiting for SAR info from Cap 1.

    It's in hand. We're emailing just now to establish facts.

          Cabot Financial ( Marlin) Limited have just replied to my CCA request. How many hats do these guys wear? Anyway, they haven't got it so shall write to Crap 1. My account's been placed on hold in the meantime. Hopefully time will run out for them but there's still the issue of the Ct papers.

            May be an idea to sit tight if they haven't got it great news , if you write it gives them chance to put things right and we don't want that do we ?

              This is the reply they sent. I ought to send a letter to Court/ file a defence and get this done this week if possible. I can't trust Cabot to delay the Ct proceedings. What do you think? Thanks.

                The claim was only issued a week ago so there's no rush yet.

                        The letter from cabot is a standard response but as they have already issued a claim you can't sit back and do nothing on the basis of that letter as it's the courts timeline you must follow not cabots. If they require more time you will need them to confirm, in writing, their agreement to an extension of time for filing your defence (max 28 days) and is the defendant who must notify the court otherwise you will be at risk of default judgment.

                          As the claim was issued on 20th January mike'y has until 3rd February to file AOS.

                          Our solicitor has an excellent record so it's definitely worth contacting her.
