    No they're still in default. Ignore this for now
    I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website. I am extremely busy so if you do contact me or need a reply to a forum post then use the email or PM features offered because I do miss things and get tied up for days at a time!

    If you spot any spammers, AE's, abusive or libellous posts or anything else that just doesn't feel right then please report them to me as soon as you spot them at: webmaster@all-about-debt.co.uk

                HELP!! Nothing from Natwest or Wescot BUT they have put it on my credit file as a defaulted account and I now will struggle to remortgage for a fixed rate before the interest goes up....so they have got me, one way or the other.....any ideas????

                    NastyPest done the same to me with a credit card. Never actually appeared on my credit files until I defaulted.

                    Mine was in regards to a CC debt, but would appear they hold the same process for other accounts.

                      Do you know if there is anything I can do about it or do I just have to pay it? If I can't get a new mortgage and the rates go up I am screwed!

                        Even if you pay it in full, it will remain on your file. It would show as being settled, but would still be there, although its effect would be reduced.

                          So there really is nothing I can do about it, thats not very fair is it, they can say what they like and make things hard for me and I can't do a damn thing about it....so it looks like I will have to find a way to pay them so at least the effects are lowered and then try and fight for it back which I guess will be pretty impossible!

                            Does anyone know if it is possible to agree to a settlement and part of the agreement is that the default is removed from your record? Trying for this seems like my only option right now!

                              Ok, I have drafted this and would appreciate comments/ideas if anyone has time...

                              Following the letters which have been sent, I write now to come to an agreement with you to resolve this issue as it is now affecting my health and the financial security of my family.

                              Whilst we are negotiating this I would like to remind you of the following points:

                              1. I am still awaiting the information requested in my Subject Access Request which was sent in May 2013 and which you confirmed receipt of.

                              2. I wrote several letters to you in the year or so prior to this asking for the account to be frozen so that I could resolve the issue without incurring further charges on an account that you had admitted was clearly not being used.

                              3. I paid £2,000 into the account circa 2010 which I fully believed cleared the account, unfortunately this did not completely clear the total outstanding amount and therefore the amount you are now demanding payment of is made up fully of charges, firstly these sat within the ' agreed' overdraft but then the charges took it over this amount and so the further charges were added for it going into an unagreed overdraft - during this time I thought the account was clear and as I was not using the account had no idea these charges were being applied.

                              4. You have placed a default on my credit record, I was not notified of this as I believe I should've been, nor do I believe this is fair given the circumstances including the fact that you have not complied with the law in providing me with the information that I have requested and paid for.

                              5. You have now passed this to a debt collection agency, still without providing me with the information that I should've received.

                              With all of the above points in mind I propose that we come to an agreement to end this matter once and for all.

                              Therefore I request that you contact me as soon as possible with your proposal, if I do not hear from you within 14 days then I will have no choice but to contact the financial ombudsman to seek a resolution.

                                Most DCA's and lenders refuse to remove CRA data if it's accurate. We have templates for this scenario in Making Offers sections (AAD Templates).... Good luck.
