      Re: Welcome to Nellie Newbie

Thank you very much for the welcome.

I have found my way here from MSE.

We have just been through the government's Mortgage Rescue scheme and as part of reviewing our financial situation, I hope to get some advice on which of our agreements are enforceable.

      Kind regards,

      Nellie xxx

          Ooh thank you!

Talking of signatures... what does it mean by 'sign digitally'?

It means TYPE or PRINT your sig as companies in the past have been known to do a few naughty things with signatures

Thank you. I did search for 'sign digitally' but it brought up loads of results!

I understand now, but just to clarify, does that mean if I have signed other correspondence sent to creditors that they are allowed to cut my signature from that correspondence and paste it into a scanned copy of my CCA? Or do you mean they might do that illegally?

They are allowed to do it to recreate an agreement in line with the Carey v HSBC judgment and they do it frequently (if in arrears) - so if you're in arrears NEVER sign. For normal day-to-day banking etc, its fine to sign normally.

Its not illegal if they use the signature (copy//paste) to make a recon - only! It should be, the law's a joke, but it isn't.....

Thanks for clarifying that for me. I am gobsmacked the copy and paste thing is allowed in any circumstances!

Exactly my stance, legalised fraud! No other word for it... however Judge Waksman is a wee bit arrogant to say the least! It really needs appealed cos Imagine it, right now I could create agreements and start accusing you all of owing me money! Though Waksman stated banks have a reputation and will do it honourably - whose he effin kidding, banks have NO reputation
