    An avatar is that little image under our usernames..... We tend to use Mr Men ones here as we are the Mister Men fighting the Muppets
    I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website. I am extremely busy so if you do contact me or need a reply to a forum post then use the email or PM features offered because I do miss things and get tied up for days at a time!

      Mint have been paid £1pm for a year now and haven't bothered with a DCA. They just defaulted me, accepted the money and send out statements each month!
      Hello again Flossy,

      I had been paying them through a DMP until a couple of months ago. I also had had minimal hassle from RBS Mint and they were one of the few to continue sending monthly statements (without interest). They haven't sold on the debt yet, and of course, they expect me to repay the balance still.

      It was very recently that I got the CCA back -- the last week of January. It was enforceable but I sent a "Missing Prescribed Terms" letter and they've replied to that just the other day (link to my diary posting here), effectively saying: "oh yes it is enforceable" and "we won't discuss this any further".

      A month ago, I probably would have been in a kerfuffle about this, but I had a look through other diaries with RBS Mint dealings and I don't see the point of negotiating repayment just yet, even though it's enforceable. I'm reckoning I'll be better off waiting until the bitter end when they (or more likely their gimp friends) start seriously threatening legal action for real ... in the meantime I can stash the money I'd otherwise have been chucking into the bottomless DMP pit and save it for F&Fs ..!

      It's Very UEarly Days yet though!

                The reason you've never seen one like this before is because all they've done is issue an A4 typed up copy of the terms that may have been in place as at account inception and the current version - irrelevant as that does not satisfy your s.78 request based on the documents not proving anything, let alone proof that you agreed to and signed acceptance of said terms.

                Point is, it's unenforceable



                I would not reply to this just yet, wait and see what they send next - keep us updated, however for clarity the next template you will send no matter what they write out to you with, will be this: ---> Our Templates | Unenforceability Templates | CCA Query - Copy Document Received

                      Your right worrying doesn't do you any good at all. I know through all of my debts of having sleepless nights and frantically running around like a headless chicken. Niddy has made sure I am calmer with help of people on here you do learn that it doesn't get you anywhere, but, I know its really hard though to just stop.

                      I will have a look at your link and we can compare notes. I am still waiting my Mint CCA to come back .

                      That's ridiculous about not discussing it any further with you after asking for the missing prescribed terms. They are happy to reply to your CCA and tell you its enforceable but not discuss that!

                      I will have a read of your posts and can get a better idea of whats been happening and reply when I have a better understanding of it all.

                            Hi All,

                            Niddy - I have got my CCA back from Grattan Catalogue dated 2nd Febraury 2012.

                            It says that basically, they are writing in response of my request and please find enclosed a reconstituted copy of your current agreement with us. This approach is consistent with the requirements of the CCA 1974, as amended.

                            Goes on about the account being in arrears and that EOS Solutions need to be contacted.

                            Basically, it says on the next 2 pages that they need a copy of the signed agreement and I need to sign the agreement (on the next page without my signature or anything but, someone has written my name and address) NOW, and return in the envelope provided!

                            I will email you it but again this looks UE.

                            The next letter I have just received says if I do not pay within 7 days their litigation team will seek alternative methods to ensure its paid. DOORSTEP VISITS, etc...

                              Also, Creation have sent a note that I am getting a visit from one of their representatives to call at my address.

                              Will post this on my Creation / SCS bit and hopefully can get some help with a letter or something?? They are now just ringing and no one speaks and puts down the phone.
