    Instead of going around in circles, why don't you stop trying to mislead me and instead send a legible and compliant copy of the alleged signed agreement that you claim was made between myself and Natwest Bank.


    Until such time you comply with my lawful request, I consider this account to remain unenforceable and in dispute.

      I am and I get an email but an agreement coming really isn't important - in so much as that when I am trying to help with over 30 claims then sadly, things need prioritising so I say give me at least 2 weeks to get round to agreement checking

          I know, and I'm sure I'm not the only one who feels terrible for 'reminding' you. It's just that we are all in our own little battles and that becomes a priority for us when something like this comes up. What doesn't help is the slight delays that my situation has introduced in this particular timeline due to me working away again at the minute so only back every couple of weeks to deal with anything that turns up. Thankfully, that is getting less and less due, in no small part, to you and your amazing site. I cannot thank you enough and I will get that response sent off on Saturday, recorded of course

            Just send it proof of postage mate - no need to pay for recorded

                Well they haven't hung about. Shoosmiths have replied to my Niddy letter basically saying that we are not going round in circles, they have complied with any requirement under the CCA and have given me until 22nd April to supply them with my repayment proposals or they will issue proceedings without further notice. What next??

                    This may sound arrogant, but to be honest there is no signed agreement hence it IS unenforceable.

                    I'd respond, if it were me, along the lines of:

                    Dear Sirs,

                    Ref: xxxxx

                    I write with reference to your recent letter. This is formal notice that should you issue proceedings, knowing full well that you and your client are in breach of my lawful s.78 request, that I will defend any such claim, I will show the court a copy of this letter and I will consider requesting costs due to your unreasonable behaviour especially knowing I am a Litigant in Person.

                    You cannot simply ignore your clear obligations and I will ensure the court & your regulators are fully aware of your totally unreasonable behaviour. You still have a duty of care and issuing proceedings when you know you do not have the required paperwork to enforce any such claim shows a clear disregard toward your obligations.

                    I suggest you revert with your client and send me compliant documents in line with your obligations under the Consumer Credit Act.
