      16. 09/11/11 - Sent Final Response - Unenforceability (No CCA Received)
      17. 15/11/11 - Received from Barclays - They feel they have fulfilled their obligations and complied with my s.78 request..... Re section 61, they point to paragraph 230 Carey vs HSBC, and say "It's insufficient.. to point to the absence of a signed, or a proper s78 copy as a foundation for a plea of an improperly executed agreement... They believe my credit agreement to be fully compliant and will oppose allegations that it isn't..... With regards to the OFT, they do not hold my account to be in dispute..... Attached was a copy of my CCA

We want to help and are able to offer installments to clear the balance... We will continue to contact you to resolve this."

      23. 22/03/12 - Received from MK Rapid Recoveries - As you've not taken up our offer of help, as a legal requirement we must inform you we're instructing our pre-litigation team to review your account.... They may commence litigation... It's not too late to resolve this.
      24. 30/03/12 - Sent to MKRR Our Templates | Unenforceability Templates | Threat by Creditor - Threat-o-Gram Letter Before Action
      25. 14/04/12 - Received from MKRR - We've requested a copy of the documents from BC and this will be forwarded to you in due course. (filed)

      UPDATE

      04/05/12 - Received from MKRR - Further to your letter, please find copy statement as requested. Please contact us to discuss repayment. Enclosed were copies of all statements on this account dating back to its inception in 2006.

      Bit of a strange update, I've not made a SAR so I'm not quite sure why they felt it necessary to send all statements from 2006 (not that I'm complaining). They actually make quite interesting reading as pretty much all entries on there are either for building materials for work on the house, or kids clothes/trainers/shoes/uniform etc (worst period ever when they were both going through growth spurts on a monthly basis for a good 2 or 3 years, thank god they've stopped growing now!).

      I also noticed that as soon as I reached my credit limit, I stopped spending - and then within 2 months they had increased my credit limit so I'd start spending again... happened at least 3 times, exactly the same pattern within the space of 4 or 5 years. It makes me realise that although I am responsible for having spent the money, they also need to take responsibility for making it so easy for me to have the credit facilities available for me to be able spend the money - if all of my CC creditors had never increased limits (unrequested), chances are we would only ever have been in half the debt we ended up in.

      And this is why I have no issues with taking the UE route where possible

      Enough of my waffle, I don't really think I need to respond to MKRR for having sent me statements and so (unless told otherwise) I will file and await their next move.

        They think sending a bunch of statements is proof enough.

        Cabot did the same with me, not heard zip since.

          Update - 05 May 2012

          Due to HSBC starting formal action the relevant HSBC posts have been copied to a new thread in the protected legal section whilst we refer this case to our solicitor to see if they can defend.

              play dumb and request a CCA (only if your last request was not within the last 12 months though)

                CCA request was sent to (and fulfilled by) Egg last Aug, so not quite 12 months ago, but then Barclaycard took the account over and I've not requested CCA from them yet - I wonder if they may have mislaid the agreement in the transfer?

                Should I drag it out a couple more months and then CCA Barclaycard?

                  Nah, sit tight - nothing worth sending off. Forgot it was Barclays who took the debt over, very unlikely they'll hotly pursue..... Keep us updated though

                      Seems as though I didn't have to wait long for Barclaycard to send the same letter re the other old Egg account. I'll file this away and await further contact from them.

                        I was just looking through my creditors list and I've realised I've heard nothing from MBNA since last Nov. Due to it being EN, I've been making token payments of £1 a month all this time though so obviously the SB clock hasn't even started ticking yet.

                        Should I cease the payments and see what they do?

                                I'd stop paying and wake them up, they have probably put your letter in the even less urgent than normal pile
