    If a DN quotes the above section does it only apply to regulated agreements.Or can it apply to any unregulated(exempt) also?

    Hi Greymatter,
    References in a DN to section 87 (1) of the CCA are only relevant if the agreement is regulated by the CCA.
    Unregulated agreements (should) carry the terms/conditions of default within the contract. These would be policed by the Financial Services Authority and (I believe) fall within the remit of the Unfair Terms in Consumer Contract Regulations, OFT Debt Collection Guidance and CPUTR 2008.

    Can you be more specific about the problem..eg type of agreement etc?

      This is, I presume, the Amex chargecard you refer to?

        Yes indeed Niddy/Shep plus the Loan agreement that I show in the Diaries section Barclays select.
        Just looking into as much as I can ,with AAD help.
