  • is this a credit agrrement?

    A friend of mine is being chased for debt they do not recognise, the DCA then sent this.

    That is not enforceable, not a hope in hell of them using that in court
    I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website. I am extremely busy so if you do contact me or need a reply to a forum post then use the email or PM features offered because I do miss things and get tied up for days at a time!

      However if he does not recognise it why would he cca the lender? He should be sending prove it letter!

        They actually never CCA'd the DCA, they kept returning letters writing on it words to the effect of "I do not recognise this debt" this was returned every month. Then the DCA sent a letter with this attached and the letter asking them to send proofs of ID, utility bills and confirmation of where they lived. I told them not too till I asked you guys what this was. Should they send a letter if so is there a template?

          No they should ignore it if they do not know about the debt.... just ignore the DCA letters for now.

            lol. So much for the DCA being sure of who the debt belongs to. Major breach of OFT guidelines there - looks like they dont know who they are chasing.

            Let the expert confirm, but I would be ignoring completely I think.

              I'd ignore it as well. If they get heavy then come back but reveal nothing at all to them that they have asked for. All very naughty as Niddy and Oscar have said.

                I'd be ignoring too, I think my kids could produce something more professional and legal than that!
                Some days you're the pigeon, some days you're the statue. I currently spend too many days as the statue......but thanks to this site not as many as I used to!
