    I have 3 CCJ's that are over 6 years old and would have defended them, had I been wiser, however, I have been paying them all this time and wondered if they could take action if I stopped, or would they need to take me back to court?

    as they're over 6yrs, they don't go SB as such but the lender will have great difficulty in pursuing based on the fact the judge will say "why has it taken so long to deal with the matter" plus they'll need to show that they have tried to sort this, from their end.

    Basically, you should be fine - they'd need to take you back to court now.

      Would that still be the case if the OP has been paying the creditor all this time right up to date, which means the creditor will argue that they have been "dealing with the matter" all along I would think a return to court would be necessary for anything new such as an attachment of earnings or a CO, but the OP may need to check whether the creditor can send in bailiffs to enforce if he/she suddenly stops paying. I presume it depends on the amounts outstanding of each CCJ and whether they were forthwith or instalment orders, and most importantly whether the OP is a homeowner.

          Sorry I missed this, as he has been paying all this time then naturally, they are live and hence need to be continued.

          If you stop paying they may try and enforce.

            I suppose if the monthly instalments are no longer affordable then the OP can probably apply to the court for a redetermination if the creditors are too stubborn to agree to a voluntary reduction

              exactly, that's normal process.

              N245 is the forum usually used to vary the order. Here ---> Venues and forms

                Thank you for the well thought out advice.
                I was just testing the water on these, as the amounts outstanding are under £500, it would seem prudent to just continue paying them until satisfied.

                  Indeed, or consider a simple F&F to settle quicker.... maybe offer £200 in one go for completion? The DCA may well bite your hand off....

                    They are no longer showing on my credit file and not causing any problems, so they can wait for the money, it probably pays for a cup of coffee or two!

                        Well just to add to it, I have two CCJ's that go back to the mid 90,s. I stopped paying them in Jan. One is for £248 the other £1600. They have huffed and puffed a bit but nothing had happened. Saying that I haven't been home for nearly a week so who knows and also I have no assets or job
