An ongoing problem with a default on a Capital One card.
This card was taken out Oct 2006 and I defaulted on paymants June 2013.
Was being hassled by Cougar Financial so on advice from this site I sent a CCA request along with £1 payment(July2013).
Have not received any...

Enforcement without pre 2007 CCA
Previously it was discussed that a CCJ can be awarded where a pre-2007 CCA is not avalaible, but cannot be enforced.
It was also considered that Charging Orders are not Enforcement except when there is also a payment agreement. Equally Statutory Demands are not Enforcement.

I had a provident loan which I stopped paying. It has gone to Buchannan Clarke and Wells who have now bought it. They have sent a formal demand and now a threat of court action . Thing is I am not sure if there is anything I can do other than pay.... -
