  • possible car write off over a paint scratch !!!

    my parked renault espace was hit by a hgv2 lorry in my street causing a paint scratch along the back panel, rear door and side indicator. the car is probably worth £600 tops but was in good condition and ultra reliable. my insurers say they have not received the estimate through yet from the bodyshop, but have told me the car will probably be wrote off because of this.

    There is no panel damage at all and just the paint scratch.

    my question is this, am i within my rights to ask for the car to be bought back and kept. ive heard that most insurers will let me keep the car and just give me a lesser payment for the car.

    Any knowledge over this please

      Once you accept a settlement, the car will belong to the insurers to dispose of how they wish. I believe that some insurers will let you buy the car back, probably for scrap value?
      You then need to check whether they would be prepared to re-insure it and on what terms. As they have already paid out the full value of the car, they mightn't pay out again in the event of another collision, so fully comp insurance could be a waste of time if this were the case. Also, they might not even register it as a write-off in the circumstances, but it is their decision, so best to check all above points with the insurers.

        They class it as a write off simply because the cost to repair the paintwork outweighs the value of the car. In their eyes, it makes sense to not repair the car, although i know this doesnt help you.

        Can you not just tell your insurance company you wish to withdraw the claim? i dont know how it works in this senario, but in the past when my excess has been more than the damage, i have just told them i will be withdrawling my claim and they have been ok with it.

        Then you can decide whether you want to find a cheaper bodysprayer or leave it as is.

          Only problem with this matey is that most insurers nowadays will still keep a record of the fact that an accident occurred, even if a claim is not followed up with. So if the OP states on further insurance quotes that they haven't had an accident (even though claim will be withdrawn) this record will be enough for them to wriggle out of paying up.

          If insurance is fully comp, then it may be worth seeing if the insurance company will allow a 'buy back', and doing the maths. If you can get a cheque for £500, buy the car back for £300 then you have some money in the bank and if you're not bothered about driving around in a car with a big scratch on it your quids in.

              I saw a TV programme along those lines, but for house insurance. I can't remember the full details, but the clients enquired about claiming for a wall which was starting to show movement , but decided against it. The fact they had enquired was marked on their records as a claim, even though they didn't go through with it.

              When they went to put in another claim some time later, the insurance company wouldn't pay up because they didn't declare a previous claim!
