101 MPH - Is it a ban?

As per the header, my mate got caught at 101MPH by a van parked kerb-side apparently like a speed van thingy majiggy.

Obviously the speeding issue aside, is he buggered or is there any legal loopholes known to users such as licence for the van to be parked there etc......

Any help appreciated.

Niddy,

I think you will find that is a straight summons with no points or fine offered, it certainly was with me doing 105mph on the A34.

I just admitted to it on the summons and got 6 points plus a £320 fine, however this was 10 yrs ago so likely has changed.

Not something I really know a lot about. Only ever had 3 points.

My understanding is anything over 30mph over the limit is a ban. But I have heard that the cameras have to be calibrated regularly and sometime they forget though causing the fine to fall though.

That is a good point as for me I was in a 70mph limit and it was 3am in the morning.

It was A64 from Leeds to York which I believe is a 70MPH carriageway.....

I'm looking for legal arguments such as cases that won based on a legal loophole guys

legal loophole which i know of most obvious, is asking to see the calibration data and date that it was last serviced. If it hasnt, you can get it thrown out easily.

There are other techinques i know of, one which a police officer told me himself (family friend)

If you get a letter saying you have been caught speeding, leave it unsigned, apprently they cant act unless you sign, signing means you accept their penalty terms.

This is ofcourse only if you receive a letter to send your licence off to have points added, if its a summons that aint gonna wash.

About 15 years ago, i was caught speeding coming back from Blackpool, they clocked me at 91mph, my top speed in reality was 120mph.

I got 3 points and a fine.

The easiest and most straightforward way to avoid a ban is simply to ignore the s172 notice. This will result in a 6 points and a large fine as well as pretty big insurance premiums over the next 5 years.

However having said that as it's not Scotland a ban is a low risk and even then would be short for 101 mph.

Signagage defects (Bentleys speciality) tend not to go down to well in cases of high speed. Just ask Craig Nicholas Jones.

But the road between Leeds and York is obviously not in Scotland (unless someone has moved the Border AGAIN )
