  • disipline hearing for something not at fault. help !

My wife has a disiplinary hearing on Tuesday for something at work which she has not done.

She works with adults with disabilities and every day they are given medication, same tablets am then 12 hours later pm

The drugs are counted and signed for before they are given then the same routine 12 hours later.

My wife has been accused of giving pm drugs on an am shift which they say put the count out.

My wife is adamant she has done nothing wrong and checked the count of drugs before she gave them.

Now this is where she cannot understand why she has been singled out. The check which was done on the drugs 12 hours later was correct and the check 12 hours after that was correct, it was only after 3 checks later a count error came to light but my wife who worked 36 hours previous has been acc used ?

She has been called in and explained how can it be her when checks were done afterwards and thought that was the end of it but now has had a letter come through saying she has a disiplinary hearing on Tuesday !

    Any advice please

Has she been supplied with any evidence? She should have been in order to prepare any defence (whether she did it or not) for Tuesday. - I am not sure but I don think they have given sufficient time.

We have an employment specialist on board - I will ask them to drop by.

The evidence they have given is nothing. There is evidence to prove she has done nothing wrong, 2 separate people have signed the medication book as correct the next day.
The final statement on the hearing sheet says its probability is that it is my wife. No proof of anything

I am aware of someone (personally) that went through something very similar recently. Though that was logged timings I believe rather than doses.

However if its been logged as correct after the event, I don't see how they can go back and say what they have.

Anyway, wait for our employment experts now.

Re: disipline hearing for something not at fault. help !

Hi, sorry only just got Niddy's message - your wife should have been given all the evidence that the company will be relying on for the disciplinary hearing. As I understand it from your post your wife administered drugs and then they were checked to be correct twice after that time? What have they provided to prove otherwise? Is your wife being singled out for this disciplinary action? Sorry to ask so many questions but it is important to understand the basis on which they are basing the action. How long has your wife worked for the company? I would have thought it would be best practice to have one member of staff dispense drugs then another to give to the patient, did this happen?

If you want to PM me with further details I will try and help more but without understanding the actual evidence its quite difficult.

                    Jane x

Re: disipline hearing for something not at fault. help !

Hey MJR, I'm mindful your wife's disciplinary is tomorrow. Without a little more detail it's hard to help, I understand you might be reluctant to post too much detail in here but please pm me if you feel you want to. At the most basic level, ensure she is accompanied, check her company's disciplinary policy it is usually by a colleague or union rep. This is important if she needs to appeal, make sure that she takes notes of the meeting and ask for a copy of the company's too. If they present new evidence at the meeting she can ask for it to be adjourned to give her time to digest and investigate this new evidence. Does she have proof that two further people dispensed drugs and signed all was correct after her?

I really need to understand why they are saying its your wife who made the error so if you can get in touch that's great.

Something else came up so basically my wife was in the wrong I think. She has not had the meeting as yet, its today but thank you all for your time.
