    Just wondering whether Court action would be likely for a £120 debt to a payday loan company?

      It's a gamble for them as they'd have to pay the court costs up front. They may do if they think they could get a judgement against you where they think you would be able to pay in a relatively short time.

        Very very unlikely - who is the creditor?

        In 6 years supporting people challenging payday loans I've only seen two claims issued, and thats because both buried their heads in the sand and didn't challenge them.

          I have just received a letter from payday express saying they have forwarded everything to BW Legal to continue to deal with the £120 debt. Should I be worried about this company?

            I don't know anything about payday loans but I would think its highly unlikely. BW Legal's website says that they issue 1000s of claims a month but I've searched through the records of claims on here and I can't see one from BW Legal. Let us know when you hear from them.

              i have received their letter in the same envelope as one from Payday Express. It goes on about the usual I.e pay in 14 days or further collection activity will happen. They also give details of Stepchange etc etc. Also there is a direct debit slip at the end to set up a payment plan. Usually I wouldn't worry too much but the word "legal" and also the fact they are registered with the solicitor regulationary authority has caused me to post on here for further advice on how to respond to them.

                An I get a little bit of advice on this issue. I decided to bite the bullet and set up an online payment plan of £1 a week with BW Legal for this debt. It looks like they haven't accepted this offer and have asked me to phone them (this is something I would never do). Does anybody have any history with this company? On further investigation I am under the impression this is the debt recovery arm of the business rather than the actual solicitor side of things. Should I be too concerned? Thanks in advance.

                  Now that you have decided to pay them they will be after you calling to pressure you into paying a bigger amount, they will want to know your income and expenditure, You DO NOT have to supply this info, write to them, explain that this is all you can afford at the moment, that all contact is to be in writing and on what date the payments will be made, If they don't agree with it you want to know why, but still make the payment now you have started,

                  Just my oppinion others may have another Idea xxx

                    They actually phoned me this afternoon and were happy to accept £1 a week. I explained I am on a DMP and that I couldn't be seen to favour any one creditor. They asked for a copy of my Stepchange I &E but they can whistle for that.

                      Personally I wouldn't have paid them anything. You need to have that offer in writing and you need to know if it's £1 per week until it's paid or are they going to review it in 3 or 6 months.

                        I appreciate what you are saying but in the back of my mind this firm looks like it would take court action more than any other I have been dealing with, even though the debt is very small.

                          Hi, I really don't have clarity on this question to answer it but I would like to get clarity from someone here. I think it's not fair on the lender part to get back after 120 pounds.
