This is what they wrote in previous correspondence with their repayment plan, no idea whether this will apply if I was to start paying the £16

We are unable to freeze the account and set up the repayment plan until we receive your initial payment.

Your account will remain in collections until your initial payment has been received.

Please be aware that whilst your account is not in a repayment you may incur charges, our system may try to recoup the funds and your account may be sold to a third party debt collection agency.

Is this 'Michael' again? I'd consider sending the following:

      <start of letter>

      Account number: xxxxxxxxxxx

      Dear Michael

Thank you for your email of xx/xx/xxxx accepting my payment plan of £16/month in relation to the above account.

I am sure that you will agree that freezing interest and charges on the account and preventing the balance from increasing is to the benefit of all parties therefore could you please confirm that interest and charges are now frozen on this account, and once this is confirmed I will set up a standing order to commence monthly payments with the first payment being on xx/xx/xxxx.

Thank you for your assistance again and look forward to hearing from you.

      Your sincerely

      Cecilia

No - forget that. That is what they stated in previous correspondence, and its an automatically generated template email.

We need to work on the non-templated emails from Michael as thats what is going to get us the result. Respond to him with the email on post 225 and see what he says.

I am confused now. I made an agreement with PaydayUK who accepted my offer, and I would pay them by standing order starting on the 4th October.

            This was the agreement.

            Many thanks for your email.

They can try to take payment as much as they like - they're not going to get it are they?

This is another automatically generated email - problem is their systems just aren't geared for dealing with arrears/collections so they have entered your payment arrangement into the system and it will still try to take automatically.

If you want to keep a comms trail going a quick response along the lines of 'as per my email of xx/xx/xxxx, first payment will be made to you via standing order on xx/xx/xxxx.'

Sounds like a result to me! They have confirmed that all future interest and charges are suspended, and payment plan agreed.

The email from David is a standard email so wouldn't worry about that.

                    Well done!

Received another notice of arrears today in the post today from Pounds to Pocket, dated 30th September slightly different to the one they emailed me in #207

This notice is being sent to you as required by the Consumer Credit Act 1974 because you are behind with the sums payable under your loan agreement.

Please review the Office of Fair Trading Arrears publication that describes your rights and responsibilities

                                Loan ID
                                Funding date 6/7/13
                                Loan amount £1,146.66
                                Opening balance £1,079.38

Two or more installment payments under the above loan from Pounds to Pocket are overdue. Because of these overdue payments, your customer status has been changed to "In Default."

Below is the list of installment payments which are overdue

                                28th August 2013 £177.23
                                25th September 2013 £177.23
                                Total £354.46

As a result of your returned debits on the payment dates above, we have assessed £24 in Dishonour Fees. This amount is also now due. You will receive separate notices in relation to these Late Fees.

No further fees or interest are accruing on these amounts.

Total current outstanding balance of the loan £378.46
