Not too good news with my packaged reclaim/FOS

    Like Lloyds I'm unable to find the loan details from Jan 2001, but can in regards of a loan taken out in Nov 2001, strange, as I am sure the loan before Nov 2001 was taken out in the late 90's and any paperwork i have come across all the loan docs but not that one Jan 2001, even on the paperwork "Products offered" are from Gold loans taken onwards from Nov 2001.

    I will keep looking over the coming days, but the GOLD package account was upgraded to us in year 2000, so the GOLD loans were not taken out directly when they upgraded.....in 2001.

    I did find better info on the income criteria before and cant for the life of me find it, i checked all my docs too :-/

    I shall see if i can get anything by googling lol x

      It seems i have come across the Credit Agreement for Jan 2001 loan, it does state Gold Service Loan at the Annual Percentage of 14.0% and Nov 2001 is also at 14% Annual Percentage accordng to the agreements, let me know if you want me to post them up - minus the personal name/address details etc. Thanks.

      I wonder if the last Adjudicator did send that letter that was done Niddy.
      We noted the comments about the loans and stuff on it and expressed that we did not specifically take on the loans just because of the preferential rate, and that I would have taken the loan whatever.

      Do you think I should also make sure with the new Adjudicator as well as forwarding him the letter again just in case?

        As an aside, do you know the normal non discounted loan rate from 2001?

          LOL rightio, you know me well lol!

          I've no idea of the non-discount rate, but with the fee free account when we had a loan (as we also used the Jan 2001) loan to pay off the previous loan taken out prior to 2001, that was about 16% APR.

            It might well be that the fos look to assume the loan was full rate and see the differences between that and the reduced rate then work out whether the refund would be greater or less. Obviously you could be fighting for a grand refund yet the loan could set you back 2 grand by using the full published rate, who knows.....

              Lou from LB just succeeded with her's against Halifax, of £8K backdated from 2001 to 2011, WOW, so happy for her, they included all overdraft int charges too!!

              Crikey I was paying almost £75 or more on top of the £25 premier account for 2 years, as they upgraded whilst we were already in overdraft, can clearly remember that well though, because although there was an available OF balance to use both me and hubby were having issues in B&Q DIY with a purchase, we had about 15 mins to catch the bank, the manager asked us to sit for 5 mins whilst he went to the upstairs office to check, he came back down and directly said to us that the problem should not have happened but confirmed he upgraded us from Platinum to Premier to stop this happening again, nothing signed (again), of course if we had known back then what we found out now about mis selling of these account packages then we would have said something then.

              From then on we fell into worse financial difficulties as hubby's Steel works went into administration a few months down the line (just days before xmas) with no pay from them or the social for 8 weeks!

                Okay, shall I start writing a rough/draft letter in regards of the comments?

                Where to start lol!!

                Now in regards of the comments they want from me, it does look like they want me to comment on the loan rate of the first one, but I only have the agreement part that states 14% and no other related paperwork, so do i enclose the copy of just let them know as they may ask me to prove this to them?

                Now the income part of it I found on researching it, I did find a better site before and for the life of me not able to find it, or is it they want me to send proof of our income?

                I note they mention about `1996 of the Gold account but then that would not have applied to us then, because I held a classic account and hubby left his lloyds savings account to come joint on my lloyds classic account, where were were eventually paying £5 to then later £8 a year, where the bank in time upgraded it to GOLD in year 2000 for the same amount of £8 per month. (This is what confused us as the amounts were the same per month) etc as explained in previous posts.....

                  ..........The first statement that shows Premier upgrade was 4th May 2007.

                  Prior to that it was platinum from Gold. (Just want to add this here in case I forget lol)!

                    Packaged current accounts are big business for banks, but not all the account's customers are happy about the changes, says Emma Lunn

                    Lloyds TSB is increasing the monthly fee on its Premier current account from £15 to £25, telling customers that the extra £120 a year will give them ID theft protection "worth up to £83 a year" and home emergency cover "worth up to £100 a year".
                    The bank has around 100,000 Premier account holders, which is aimed at people earning more than £60,000 a year. The bank says benefits include worldwide travel insurance, AA breakdown cover, mobile phone insurance, Sentinel card cover and a £500 interest-free overdraft.
                    But not all the account's customers are happy about the changes. Italo Cafollo, a head teacher from Buckinghamshire, received a letter from the bank telling him about the increased fee. He says: "I have already got insurance covering the things home emergency cover would cover, and I wasn't sure I needed ID theft, so I rang them to say 'thanks, but no thanks' as I thought I had a choice whether to take the extra benefits or not. But there's not an option not to take the additional services, only to downgrade to the Platinum account, which I don't want to do."
                    Lloyds TSB is not alone in raising fees on so-called "packaged accounts". From September 1, Smile is increasing the fee on its "Smilemore" account from £90 to £120 a year. The account includes travel insurance, and motoring cover with Home Start.
                    Packaged current accounts are big business for banks. According to market research group Mintel, there were about 8m fee-paying packaged accounts at the beginning of 2006, compared with 7.2m two years ago. Last year, banks took about £874m from fees on these accounts - up from £650m three years ago - and this figure is set to rise.

                    In regards of this account, surely Lloyds should not have upgraded us to this, our joint income was then no more than £24K.

                      (Sorry lots of posts because I may need this info to put into a letter)

                      Now going back to the Premier account again, that they upgraded to us in May 2007, we were in a very hefty OD, on checking, the part of that OD was £500 Int free overdraft, now how on earth would be have benefitted, we did not meet the income criteria of £60K or more as stated in the above post) maybe we would not gone out of control if our income was at that, but they upgraded us knowingly that the £500 int free would not have been beneficial to us because it was well into the hefty OD at the time they upgraded.

                      However, it seems the Ombudsman's not mentioned anything about these other accounts, well not the Premier but more so on the GOLD, I do hope they are including Platinum and Premier.

                            So in regards of the loan, in regards of that comment about the loan prior to Nov 2001 that was taken out Jan 2001, should I just tell them the rate was as shown on agreement that of 14.00% just like the agreement of Nov 2001?
