    Hi SA thanks for your advice.

    Im currently disputing this debt as I believe the prescribed terms are illegible. However, they are aware of my mothers illness, and have apparently moved her account to another department which also apparently takes a more softly softly approach.

    since then ive received no more threats or demands for payment, so I will wait for a threat or demand from them again before I try the avenue you suggest.

      It shows that on the 26th August 2014 there was a Adjustment credit of £140.57, which has reduced the outstanding balance from £7464.50 to £7323.93.

      I have no idea what this is, no one ever wrote to me to say they were refunding charges or anything. I never even asked them to.

      I will keep that letter very safe because if they ever try to argue in the future a payment was made then I can show it wasn't.

      Question is though, would they make an adjustment off their own back? Im guessing this has arisen since 1st Credit bought the debt, received copy statements after my new CCA Request and realised the balance was wrong? or pre empting me counter claiming unfair charges?

      Whats your opinions?
      That's got me confused too SXGuy

      It could be either of the options you give...who knows with DCAs?

      Like you say, keep it safe just in case they try to use that adjustment to reset the SB clock.

        Another thought, although i am not sure of the legalities of this (and hopefully it wont be needed anyway), but no-one likes bad publicity and if you had to, you could make them aware you are going to contact the press about the effects they are having on a seriously ill lady. It would make the less-aware bank,DCA savy (i.e non AAD members) people know exactly what these scum bags are like.
        Just thinking aloud mate...

I am now saving the money each month that was making little difference to the balance and not a bit of difference to my credit file as a result of finding AAD.

          Small update. Been getting calls from. Barclaycard chasing payment. Seems IDR have finally handed account back to OC. Will wait for a letter before responding.

            No rush, As you say wait for their letter first unless you are worried about the calls, If so send them the Telephone harassment letter, Then wait for their reply, Then yours ect - String it out a bit

              Had a couple of letters from Dlc and hsbc wanting to discuss current payments. want my mum to fill out a I and e. She already pays them 50 a month to hsbc. 30 to Dlc, Thinking of writing back and saying nothings changed. Thoughts?

                Humm.
                Thank them for their concern over Income & Ex.
                I suggest writing back and reducing the payments by 10%
                As they wlll appreciate Costs have risen faster than earnings!

                  Haha good idea. To be fair hsbc have offered to settle the debt and wipe some of the balance and pay it over a max of 60 months. So it may well be worth asking

                        Sure it's worth a go. Don't want to rock the boat with hsbc tho as we have current and business accounts with them with overdrafts but could try with the others

                            Hi SXGuy

                            Will your Mum be OK with signing letters of authority for you to deal with the accounts? (It always works better coming from a concerned next of kin).

                            If you want to pm me full details of your Mum's current circumstances/medical conditions I'll happily do you a letter. (My AAD email is having problems ATM)

                            I'll read back on your threads too, but briefly, which creditors are we targeting? Some respond better than others....

                              Hi Elsa. God to be honest I'll have to go through some old paperwork and see which creditors they are. To be frank they have all been quiet for well over a year now so I'm thinking I may let sleeping dogs lie until such time as they awaken. However the ones who do communicate and who my mother is actually paying, which I guess could be worth a shot are Dlc, 1st credit and lowells. I can't see Dlc budging if I'm honest since they as you know are quite unforgiving. Not sure what lowells or 1st credit are like. She is repaying a capital one debt but I will need to double check who the creditor is. As I say everyone has been quiet for some time apart from lowells, Dlc and hsbc, however they only ever write to ask for a payment review. Don't really want to rock the boat with hsbc as we have to much invested in other accounts we hold with them but willing to give Dlc, 1st credit,capital one and lowells a go since 2 of them are currently seeking a payment review and she's paying the other two. Mum is happy to sign over authority for me to speak on her behalf.

                                Quite happy to say openly (although you can pm me to discuss further in private) that my mother has stage 4 congestive heart failure, suffered two strokes 2 years ago.
