    Both last paid end of may 2012.they can't produce any cca's for either account and have addlmitted it.

      Will wait to receive a chasing letter from 1st Credit before I send SWID letter.

      This one is the agreement where the terms are illegible. Think Niddy deemed this UE a few years ago, no ones been able to produce a better copy as yet.
      Yet to receive any response from Lloyds at all to my CCA request and chaser letters, it's been MONTHS now... lol

        Just a little update. Received a standard letter from 1st credit regarding Lloyds, were here to help etc. Enclosed a nice I and E form that's gone in the bin. Still waiting for them to supply a CCA so will ignore and wait for next letter

          Received another letter from 1st credit. Crossed the post with my CCA Request. This one is a threat of statutory demand for bankruptcy. It says they may consider applying for one if they don't hear from me. They should have received the CCA Request now so while that's outstanding I have a defence. Will need to consider the next move however once they comply. Think Niddy has a mate at 1st credit should it get nasty?

            Hmm, I'll look forward to that one then as my Lloyds account has also been sold to 1st Credit, though its barely above the £750 BR threshold.

              Receieved another CCA responce from Arrow who bought the M & S debt. From what i can see its the same stuff, ill double check Monday, but as it stands, its still enforceable.

              They state in their letter they have passed the administration on to someone else who will be in contact shortly. No threat to pay at the moment, so will wait for the next desk to send a letter and think about where i go from here.

              Be a shame to start paying this one after a few years of no payments.

                I have one that is enforcable. I have ben sending a SWID or a Missing PT letter since 2011 and held them off so see what comes next xx

                  mine is at exactly the same stage, although mine is unenforceable due to it being an old chargecard, had the same letter, waiting to see what happens as well

                      So I got a reply from 1st credit regarding my complaint about the threat of issuing a SD. Usual cop out, they said they were not threatening to do it but merely pointing out what avenues they have at their disposal to pay the outstanding debt. They said my CCA Request crossed in the post with their letter so it shouldn't have been sent as I had started to communicate with them. But as they are now aware of my mothers recent health issues they have passed the account on to their specialised section that deals with debtors who are ill? Forget the actual department name as the letter isn't in front of me. But sod knows what difference that makes. Less demanding threats for repayment? Who knows still waiting for the CCA Request to come back so will re look at the situation then

                          I know. You would think knowing my mother has stage 4 congestive heart failure and suffered two strokes last year they would close the account. Think I may push for that actually. I'll wait for them to write next.

                              ok so a confused update this time.

                              Just received a periodic statement from 1st Credit Re Lloyds.

                              It shows that on the 26th August 2014 there was a Adjustment credit of £140.57, which has reduced the outstanding balance from £7464.50 to £7323.93.

                              I have no idea what this is, no one ever wrote to me to say they were refunding charges or anything. I never even asked them to.

                              I will keep that letter very safe because if they ever try to argue in the future a payment was made then I can show it wasn't.

                              Question is though, would they make an adjustment off their own back? Im guessing this has arisen since 1st Credit bought the debt, received copy statements after my new CCA Request and realised the balance was wrong? or pre empting me counter claiming unfair charges?

                              Whats your opinions?

                                Firstly, i am sorry to read of your Mothers illness. If i understand correctly, you are seeking unenforceability for the accounts?
                                Perhaps continue this fight and use the good will plea as a last resort on the basis that all this stress is making your Mothers standard of living worse than it should be?

I am now saving the money each month that was making little difference to the balance and not a bit of difference to my credit file as a result of finding AAD.
