      The legal standing is only a court can order you to produce I & E information.

      Another legal standing is the creditor can issue a county court summons for the sum outstanding, and since this debt is not UE you would end up with a CCJ and probably a charging order on your home

      Only you can answer that question since it's a personal decision not a legal one.

      I would be happy to pay them a derisory sum each month for the rest of my life because sometimes being spiteful works. Each time ten quid went out of my bank I would grin in an "up yours" way

      You, on the other hand, are finding this constant reminder upsetting because it's blocking your ability to move on with your life and put all this debt stuff behind you.

      So on balance I would go for a F & F if I were in your shoes. Did you make your offer using one of our template letters?

      However if they've rejected your F & F without even attempting to counter-offer it (which really surprises me) then you're stuck with the monthly payments whether you like it or not. Alas that means you may have to dance to their tune with the I & E or simply tell them (not ask them) that you are in a position to increase the payments by £2 per month and you've changed your standing order accordingly.

      One reason why they try to insist on an I & E is to appear to be 'engaging' with the debtor in case the FCA give them a slap for not Treating Customers Fairly.

        Your advice has been so very helpful and I appreciate your input.
        I have decided to go for the F&F and I did use the 'Testing the water'F&F
        I will up date you when I have a response.

          So does this mean you have already sent the "Testing the Water" F & F Template and are awaiting the bank's response?

          If that is the case you could send a copy of that F & F letter to whomever it is chasing you for the I & E form and simply tell them that you are waiting for a response to your F & F offer. In the meantime keep up the £10 per month payments.

          You've gone in quite high with an offer of 45% of the balance so let's hope that they bite your hand off, if not they'll have to wait 70 years to get their money won't they

            Having read about many F&F over the years (AAD of course)it appears that its no good going in at say 10 or 20% as this is not a DCA but the original creditor.
            I will of course keep you updated.

              Offer accepted but they say they will inform the Credit ref agencies,Does the mean a note goes on my credit file for another 6 years as the default fell off 2 years ago.

                If it's dropped off your file that should be it. They can't resurrect it. They probably didn't take into account that it's dropped off when they said that.

                        Ok, thanks for updating, I've got them chasing me at the moment and I'm concerned that they will issue a claim so I'm trying to get more info on them but there's not a lot around that I can find.
