      Yes, FP, I must say that whilst certainly not blasé about my situation, I am more confident and au fait with the process and what you can and can't do. Or rather what can or can't be done to you and when. I am simply following the advice and process religiously as it is tried and tested. It works and has been proven to work. I'm still nowhere near shouting from the rooftops but I'm already well over a year into my UE journey and time flies that quickly that I am sure that most of my accounts will be SB before we know it. I have a few accounts who, since the first response from the AAD library, they have not responded. One I can remember is about 9 months ago! They are probably still trying to read the letter

                I would actually write back, this is shoosmiths remember, and state
                "I have sent Natwest 4 s.78 requests in the past, all ignored. As you know full well the fact you are demanding money from me puts you liable to respond to my lawful request.

                If it is your view that you are not the creditor, s.175 of the CCA1974 applies in the case of a simple assignment, and places a duty upon you to pass this request to the creditor. In the case of an absolute assignment, you are a creditor as defined by s.189. If you contend that you purchased the rights but not the duties of any agreement, you are reminded that s.189 of the Act is clear that an assignment is of both rights and duties. Your attention is drawn to ss.5(2), 3(b), 6 and 7 of the Consumer Protection from Unfair Trading Regulations 2008 (CPUTR)

                As is evident from the above quote, it is up to you to do any running around, not me!

                I await the requested documents as per my previous letter and if you're unable to accommodate the request then I suggest you close the account and return it back to the Original Creditor as right now this account is clearly unenforceable based on both your repeated ignorance of s.78 and the provisions surrounding it."

                          Two letters today from RobWay: one regarding a Barclaycard account deemed technically by Niddy which I think is just a standard letter. It is headed NOTE . . IMMEDIATE ACTION REQUIRED I intend to ignore and see what they dish up next. The second letter was regarding my Tesco account deemed by Niddy due to missing PTs. They have responded to this stating that they will not enter into repetitive correspondence on this and that they require my payment proposals within 14 days....what to do ???

                              When Gold isn't enough, there is SA Gold! New to the forum and find the UE route a bit scary? Take a look at my diary here and judge for yourself. I am now saving the money each month that was making little difference to the balance and not a bit of difference to my credit file as a result of finding AAD.

                                Robbingscum NoWay are the current holders of my long standing and soon to be expiring Crapbot farce, and I'm finding their behaviour quite extraordinary. The Notice of Assignment was dated 18th September, which is nearly a month ago, and they have sent nothing since.

                                If an alleged debt is within 3 months of the Statute Barring date, does it make sense to waste a whole month doing absolutely nothing? I suspect these equitable assignments are made in bulk, and the assignee has no idea of the actual circumstances. I certainly shan't be alerting them to the situation.

                                In this case, I would also leave them be and see which template the machine spews out next. If you were to reply to them, you could quite reasonably point out that as they are a private limited company, they have no authority to “require” people to do anything. You could also tell them that you too were hoping to avoid repetitive correspondence, and that the way to achieve this would be for them to accept the reality of the situation. Refer them back to the missing prescribed terms letter, state that as your final position, and point out that due to their entirely unreasonable intransigence, negotiations have now reached an impasse.

                                All of that can wait for next time, though.
