  • Re: BillyTommo's UE Diary

I would still send Santander a CCA request. Barclaycard sent me a CCA even though I had not paid for it or requested it, this was to "prove" that the account was enforceable! 16 months later, I requested a true copy of my CCA. They refused me after 3 payments an requests, they still refused as they said that they had already provided me with the information. Went to FOS, they would not help, until I sent a Niddy Special! FOS finally got Barclaycard to admit that, not only could they NOT supply a reconstituted version of CCA, they could NOT even provide a copy of the "prescribed terms".
Just shows that Banks tell lies, they will try their best to mislead, deceive, and t---ve, from you.(got to watch out for this new bit of legislation)

Sent the CCAs to both Santander and Halifax and Niddy deemed the Halifax one as I'll pop the Missing PT's template off when they next hassle me!

My MBNA card which was purchased by Barclaycard, deemed then by Niddy. I have had MKRR communicating with me and I have managed to keep them at arms length with one template which meant that they kept writing every month informing me that they were still waiting for their client's response. That response came in the form of documentation that I have already received and that Niddy has deemed . MKRR have now sparked up again, Christmas is out of the way so they have started reminding me that they have not received my offer of repayment ....

My NW account which has been deemed due to receiving 4 sets of terms Regal have picked up the baton with this one. They got the SWID which the duly ignored. They sent me more correspondence which I replied by asking them to read the letters that I have sent them. They have just responded as though I have never sent them a thing! They say that if I want to escalate the matter further then I nee to send them a complaint I'm tempted to ignore as they are playing silly buggers, see what they come up with next

I would just ignore them for now, they are a team of extremely silly buggers with a distressingly large penchant for red ink, muppets!

I had dealings with Weasel Credit about 16 years ago over a driving fine, before I ever had a credit card. Sadly they had my arm up my back on that one given that it was court issued, and they knew it. I remember all the red ink even back then on the letters.

It's taken over two years for them to respond to my SWID but now they have sent a we have not received an offer of repayment letter, then a please call us to avoid further action one. Latest offering is a FINAL NOTICE. I wouldn't mind something to put them back in their box for another 2 years! Or should I just ignore??

What was the reason it was deemed UE? There is probably an appropriate response in the templates relating to this, which you could use in response to the Final Notice.

It was deemed as a dodgy recon as I had not actually filled in the form. It was done over the telephone - it was to combine about 4 MBNA accounts. I can remember having the conversation clearly but cannot remember whether I received the filled in form to sign or not. It was, therefore, deemed by Niddy.

http://www.all-about-debt.co.uk/old/...escribed-terms I'd pop this off Billy, this pitiful excuse for humanity are persistent buggers, you need to keep answering the letters and make them totally aware that you're not going to lie down and let them tramp all over you, just be as big a problem as you can be.

I'll send that off today. It's been over two years since they had any comms from me so I think a little letter wouldn't do any harm, just to remind them I'm still here and I'm still no pushover

Regarding my Santander account taken out in 2009, I received my CCA from them, I have emailed to Niddy to have a look I'm not holding out much hope tbh but it's worth a look if only to advise on the best course of action. I have today received a letter from Howard Cohen headed NOTICE OF PENDING LEGAL ACTION. Here's hoping Niddy can come up with a plan!!

Mate it's from 2009 so not much you can do, and it is good anyway.

Regards Howard Cohen, maybe ask them for a copy of the signed agreement as all you've been sent is the terms - but where is the actual signed agreement..... that might blag it a bit. But UE is not an option sadly.

Thanks. I suspected as much because of the date.
Is there a template to send to Howard Cohen?
