    If you have NOT previously sent a CCA request directly to Capital One, then yes send off the CCA request and £1.00 PO to them.

      You have sent off your CCA request, so really no need to contact them again at this stage, wait and see they respond with in respect of the CCA.

        I sent a CCA request last month to Blur, onions & scoff, they sent me a letter saying my offer of £1.00 a month was ok and to keep making the payment each month,

          Thank you Alland and Nightwatch for your replies .Alland I will get that cca request off to Cap one tomorrow and will await empire stores reply as you suggested.thanks
          Nightwatch I hope they don't think I'm going to pay them a pound a month ,I'll be dead and still owing them lol,,!!!

          I now have to learn how to upload my cca's to Niddy and get his expert advice on the two I have received. I have read the post on how to upload documents ,but I'm still none the wiser .they do look enforceable though.

            Never say never, uploading the docs is quite easy really. I find it easier if you scan them into PDF format.

            As for Cap1 they are buggers for not signing for the letters. Although when I asked royal mail they did confirm that they had received it

              That trick is designed to restart the limitation clock. Crapbot pulled the same stunt on me five years ago but they did reverse it after I sent in a formal complaint and pointed out the facts to them.

              Assuming you sent the template from here, there is a line which says “note that these funds are not to be used for any other purpose “.

              You will need to point out their misappropriation in a formal complaint, so that there is paper evidence that you have made a legitimate request pursuant to s. 78 CCA 1974, which does not in any way restart the limitation clock.

                Hi and thank you both for your quick response .
                Jon I will get my other half to show me what to do regarding uploading documents ,when it comes to using computers I'm totally dumb , I'll mention the PDF thing to him and he can show me what to do ( I'm a quick learner).
                As for cap one I will send a cca request to them tomorrow.

                Scabhunter ,I did use the template from this site ,and if they do use my p.o. for anything other than sending my cca I will write back to them with the resonse you stated

                  Can you scan them and email them to Niddy?

                  If you do, send each cca in a separate email and put your username in the subject line.

                  Let Niddy look at them. I had some that I was sure looked enforceable but they weren't.

                            Received - there are no existing PT's with the agreement, ie those in place as at account inception.

                            They have sent current ones, good 9they're meant to) but they also need to send the originals. The current ones do not help as the rates and charges etc are all different to what they were when you took this account out ergo this is unenforceable.

                            Nice way to start things.

                                Hi Niddy and a big thank you for taking the time to go over my cca and deeming it unenforceable ,really happy with this result I will send the letter you advised first thing tomorrow .
                                I don't know where I've sent the Monument cca I'll try again!!!

                                Re. The Capquest letter I've already posted the letter that Alland advised me to send to Capital1 ,I don't suppose there's any real harm done. Is there??? Thanks once again X
