So out of the blue I get a letter from HBSC saying they were wrong to say I couldn't refer the their refusal letter to the fos and I now have 6 months to do so.

So I emailed the person at the FOS who was dealing with the case to tell them and got this reply

The final response letter from HSBC is issued on behalf of HFC Bank (this is because HFC is now part of HSBC).

Whilst Endeavour Personal Finance (“EPF”) was a subsidiary of HFC Bank at the time of sale they were a separate legal entity therefore we wouldn’t have jurisdiction to consider your complaint against HFC or HSBC. EPF was not covered by us or any previous dispute resolution schemes at the time your PPI policy was sold therefore we would not be able to consider any commission arguments against HFC or HSBC either.
