well its been a while since ive heard anything from MKDP ,got the usual letters saying we cannot fullfill your request at this time ,so come home today and have two identical letters copies of default notices ,this i assume is in response to the letter i popped off in post 265 [MRS D ] http://www.all-about-debt.co.uk/inde...on-forthcoming.
this is for my barclaycard/egg account

It's strange that the letter states default notices Oct 12 & Jan 13, but only one DN would/should be issued.

Just proves that they haven't got a clue!

They can send as many default notices as they like, its only 1 that they can actually act upon.

Its hard to see if the dates to remedy are correct as you blanked out the date on the letters, but i think a default notice served from Mercers is dodgy anyway.

I agree. How can Mercers issue a default notice? They didn't own the account, and there would not even be a notice of assignment from Barclaycard to Mercers. These default notices are not worth the paper that they are written on! Have already advised MKDP that my Mercers "default notices" are defective in law. And, that my account was terminated without a default notice being served.

                • Re: myself and barclaycard

I think these must be in response to the much earlier Letter Before Claim response as there's no request for a DN in the link above.
The DN should have Barclay's address on, not Mercers. Some of Mercers DN's also mistakenly had s.87(i) in the header instead of 87 (1). I can't see clearly enough whether that's the case here. The OFT Statement is present, sadly. What's the date on the letters and remedy dates?
You need to tread very carefully now, you've already been on the brink with a previous LBA, so keep us informed as soon as they send anything.
What's the current position with your last CCA Request?

as Elsa says, just keep an eye on it for the moment, why on Earth did the just suddenly send off a couple of old DNs? What dates are on them are they old?

I could not understand why they sent me copies of 2 defective default notices either. Wrote to MKDP to thank them for providing me with copies of obviously defective notices, confirming what I had already told them!

I thought they were both the same letters but just spotted that the received stamp is a little more slanted on the second one

I think they've been scrabbling around for some documents to send and this was all they could find, so just keep steady and let us know what happens next.
