    Oh I left that in cos that is what I do! My old job, to go into banks and ermmm, implement fraud detecting software which meant I have worked for all the banks, and thus know how they work! They forget this, but then they don't know "who" I am cos when I worked there, I was not exactly called Niddy!

        I've just had an Equifax alert!!

        Seems opus have now marked me 4 (yes four) months in arrears!!

        Screen print will follow tonight when I'm at a pc (on phone at mo)!

        Shocking - am speechless really!

          Brilliant read. Niddy, this is one i would love to know the outcome of right now !! But..... i guess its a waiting game :/

                    In post #15 - link - the report shews a credit limit of £2000, yet a statement balance of £0.

                    How is it possible to owe nothing and yet still be in arrears?

                        Nooo, it has £1k on the card or summat like that.... that sometimes comes and goes mind!

                          So they are not exempt from the legal obligation to issue statements of account, under either section 77 or section 78 of the Consumer Credit Act 1974.

                          Did the original agreement allow the account to be made into a "repayment only" account and, if not, why do those twerps think that they may unilaterally vary an agreement without your consent?

                            I never picked up on this - damn good point. So in essence they cannot enforce this in court, assuming I cease repayments (which evidently I have as i'm 4 payments late on a £0 balance/£1k balance) lol

                            I dunno myself cos i've not had a statement since last October

                              Have you sent them a request for the agreement (under either s 77 or s78) with also a request for any/all other relevant documents and a statement of account?

                              Another point that may be worth considering is whether, by purporting to have made the account "repayment only", those numpties have varied a running credit account into a fixed credit or loan account to which more stringent requirements exist with regard to statements of account, etc..

                                Nope, never done a CCA Request as I have the original agreement

                                However in that it does say APR 15.9 and their statement that they sent me shows 17.9% so I've also got em with that - you know what, i'm just not gonna pay em - sod it. Let them default me, am I bothered?

                                I am too bust fighting for other people to worry about a grand on one card! Plus i'm playing silly beggars with HSBC (seen that thread yet)?
