Re: Niddy vs Opus (ex CitiCard)
FOS and Opus requested extension so I've agreed until 21st August.

I have already rejected the offer based on the fact they are using the wrong amounts, I want the middle to higher rate compo not the lesser on (ie less than £300) bearing in mind the hassle and late payment markers/refusals etc lately.
I am looking at between £1,000 - £2,000 in distress plus any financial consequential losses as a result of them posting inaccurate and illegal data about me via a third party, ie the CRA.
My payments are not in arrears, as I have a valid DD in place and always have, just the bank do not take the payments - why? Well ask them, is what I told the FOS!I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website. Originally posted by Never-In-Doubt View PostThey never asked me if it was ok, they told me they'd given it and I threatened legal action (yea I threatened the FOS with action) in line with CPR etc based on the fact they had no sound legal backing in which to authorise such a delay. As the FOS explained, that my refusal to grant an extension, by my refusing all it'd do is delay things longer as when it goes to the actual Ombudsman they would automatically request a response from Opus; ergo to grant a 1 week extension now is the right thing to do because when I do refer it to the Ombudsman, they will have Opus's reply so can assess it quicker.

Originally posted by mgfboy View PostFair enough Niddy I miss read the posting, as for why banks dontcollect ddi's . In my current case HSBC refused to give us payment details or set up a DDI and then complained that we hadn't paid them anything!!!!
With mine the main difference was I was paying as normal, then they sold up to Opus (ie Citi did) and then Opus never took any DD payments - nothing in any of that is my fault - it is totally theirs, 100% thus the FOS had to award in my favour, clear cut case.I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website. Ok, today is the end of the "Extended Extension" that they were given, which I agreed with the FOS. So.... ping-pong email again:

Hi FOS
What do you mean? Have they been in touch? Also, this file that you're waiting on - what is it?
Being I have sent copies of letters etc, what can they possibly bring to the fold at this late stage, if anything? I do feel that this clearly goes to show their general lack of diligence when dealing with consumer complaints, as it shows they not only ignore me (ie a customer) but also the Financial Ombudsman - that must assist in your overall decision? I mean it is a joke, truly - it's a joke.
As for the next stage, what is the next stage exactly? Can you please advise what happens now? I am sorry but this is now it, the Ombudsman cannot realistically allow more time and anything they submit after a second deadline has passed should be struck off as inadmissible - I will, if necessary seek legal clarity against the FOS in this regard - that is how strong I feel about it. My point being, where do you draw the line? They have proven that they couldn't care less about customer service or the Ombudsman so why keep allowing them time? Surely you can now see for yourselves how they behave on a daily basis, ie it is not isolated, there are still several late entries registered despite being promised months ago that they'd be removed and they still have not answered my last letter to them.
When do we say enough is enough exactly? I am not having a pop at you but please, see my frustration here - If I behaved in this manner then yes, I can understand the bank acting the way they did but all they've done is drag this out from something that could and should have been dealt with over 8 months ago, into a never ending saga of pain for me. I cannot get any new credit right now, and you wonder why? I am utterly dismayed at the way I have been treated.
I sincerely expect the FOS to back me when I demand that Opus reduce my card to a 0% APR for the remainder of term plus look at a 4 figure settlement offer, ie in the region of £1000. ONLY then will I drop this, as right now not only do I have them for various regulatory breaches but also for libel/defamation/slander whichever you prefer. The consequential damages alone, in the fact I cannot obtain any credit right now as a result of their late payment markers, should be enough to satisfy my anger. In essence, If I take this legal, then I would be seeking total write off of balance plus damages equal to £4,000 in respect of the libellous data being handed out to the third party credit agency with whom never had any authority from me, for Opus, to share data with in the first place.
Unfortunately all the paperwork I have has been copied, I must have sent the original to Opus within one of my previous complaints, by accident. I am sure they will have a copy though, being they did purchase all files from Citi and declared not thrown paperwork away...
Thanks. Re: Niddy vs Opus (ex CitiCard)
I'm thinking that email of yours could be reincarnated (not reconstituted mind) into a template letter for all of us experiencing the FOS bending-over-backwards approach to their complaints/sponsors.
But more importantly although I'm an absolute fan of your determined approach to life (and inflicting severe punishment on banks/creditors in particular) I really don't want you to have a heart attack and let us all down in our hour of need (sorry to sound so selfish but hey I've got debts to sort).

I had a live DD on account, paid fine for over 2 years then when they sold up, it stopped - not my problem. I have asked them to set it up properly, they have not done so.
