    Details of Claim

    MBNA credit card was taken out in 1994. In 2009 I stopped making payments and the account was defaulted. In 2012 the debt was assigned to Aktiv Kapital Portfolio AS, Oslo, who then assigned debt to PRA group at the end of 2014.

    PRA sent "letter before claim", dated 6 May which I received on the same day as the court claim form. I have written to them asking why it took so long to reach me and requesting that they cancel / postpone court claim.

    They say on the claim form that notices of assignment were sent but I really don't recall getting them. From Oct 2011 to Apr 2015 I sent £1.00 per month to MBNA by cheque, which they cashed.

    I'm not at all sure what to do from here! Any advice would be greatly appreciated

      The Defence is due to be filed on or before 27 June 2016.

      Have you made a s.78 request under the Consumer Credit Act for a copy of the agreement at all?

        I would send a copy of the claim form for Niddy to have a look at as a first step.

            Just to clarify on the date …… It's 28 days after the date of service, which is 5 days after the date of issue, assuming an acknowledgement of service has been filed. That would take it to 27th June, so no panic.

              In answer to your question: no, I haven't asked them for a copy of the agreement. I guess that I should ask for it and other documents to be disclosed to me? (sorry, I can't remember the technical term for it but I'm sure I've seen it on the site somewhere).
