  • How could I let this happen again....

    Dear All,

    I am finding it so difficult writing this post, but I really do not have anyone else to turn to. I know I have been extremely foolish, and I know my friends will not judge me on here.

    Due to a difficult few months I have got involved in PDL yet again, I am beyond devastated.

    I have been in hospital and my Mum has to recently, and Dad had a set back again. Thankfully my operation went well and the results were positive. Mum has fully recovered and Dad is doing well again. However I am extremely depressed and feel so isolated. I think I may need to go and see my GP soon.

    The issue I am having is with a company called cash4unow ( novo loans).

    I have missed a payment this month, however I contacted them a week before the payment was due, requesting that they cancel the CPA and asking can they place my account on hold for 30 days, to allow me breathing space. I have received several emails saying NO my account will not be placed on hold and requesting a sick note and a wage slip. I am not off sick so cannot understand why they want this. Yesterday I made the dreadful mistake of calling them, the person I spoke t wax patronising and did not show any empathy with me, I actually was crying on the call and had a panic attack, I could not breathe. I was told the account would not be put on hold.

    This company seems so aggressive and I am so frightened. This morning I have received an email which is a default notice with a £5 charge.

    My dear friend SnV, have you had any dealings with this company?


    I am so ashamed that I find myself in this mess once again.

    firstly natty, get yourself of to the Doc's, he needs to know how you are feeling.

    Secondly, do not phone them and get that CPA cancelled at the bank, at your end.

    S&V will be along for the rest, but you need to look after you first.

      Hi natty, sorry to hear that you have had a few rough months. As MrsD has said, cancel your payment, don't speak to anyone on the phone and get yourself to the doctor.

                Hi Natty

                Great to hear from you, even if circumstances seem a bit bleak right now.

                So lets try to put things in perspective, this is whats important right now (in no specific order I hasten to add!):

                1) Your health
                2) Your parents health
                3) Paying Rent/Mortgage
                4) Paying Council Tax
                5) Friends/Family
                6) Enjoying life
                7) Paying essential bills (gas, electric, water)

                Novaloans do not come into this list ever, at any point. The important thing here is you cancel the CPA immediately, then we can deal with things from that point.

                Email this to the payday loan company:

                Dear Sir/Madam

                Account No:

                With immediate effect, I withdraw my authority for all future payments to be debited from card number in respect of the above loan. This is in accordance with my rights under the Payment Services Regulations 2009, which state:

                “The payer may withdraw its consent to a payment transaction at any time before the point at which the payment order can no longer be revoked under regulation 67.”

                Please confirm in writing that you have received and actioned this instruction.

                I look forward to hearing from you.

                Yours faithfully

                Send this to your bank immediately - take it by hand into your local branch if you must, but make sure they also receive it - do not rely on the PDL company to cancel the CPA!

                  Ok - so from now on DO NOT contact this bunch by telephone again.

                  Second - when you initially contacted them by email - could you let me know what you told them, and what circumstances you asked them to place the account on hold. They are potentially in breach of CONC guidelines by refusing to give you time to seek advice.

                    Thank you for getting back to me. You are right all the above are more important, but you know me I go into melt down at times.

                    I have already sent the above letters last week, after all I have learnt from the best, that being you. I have also sent a formal letter of complaint which has been acknowledged this afternoon. I am going to send them a further email regarding the harassment.

                    I have all the tools from you how to deal with PDL. I am just so wary of this particular lender as they seem a lot more aggressive than others I have dealt with.

                    I hope life is treating you well.

                      Its great to hear your're confident dealing with them - don't feel that you have to do it on your own though ok?!

                      If they're being more aggressive, then its doubly important that you keep everything in writing, and then, in a dysfunctional way, this actually helps you because if they are in breach of FCA CONC guidelines, the lending code etc then you have a stick to beat them with.

                      As your complaint is in, they have 8 weeks to respond. I'd be inclined to do nothing until you get their formal response, and in the meantime get yourself better.

                        Hello SnV, Sorry I missed post 9.

                        When I called them I advised that I was in financial difficulty and that I was In an extremely vulnerable position. The person I spoke to was dreadful, I was actually In tears during the call and could not breathe, not once did that person ask was I ok. They just stated they would NOT place the account on hold.

                        Thank you so much for still offering to assist me. I really do appreciate that.

                          im kind of in the same boat so i sympathise, im on a DMP at the moment but what im doing is doing final offers to my creditors and so far out of 2 both have accepted my offer to pay only half the balance. cancel the payment and stop paying! cancel any method of payment they might make like CPA/direct debit, do this with the bank and ask the lender to cancel the CPA as well (worth a shot!)

                          did you hear back about the complaint you made?

                          email them and just tell them how much you can pay, lie if you have to and say you are on the sick from work and you are not on full pay, basically keep sending them the same email, they will get sick eventually and given in and sell the debt on, if i was in your position send the exact same email you already sent them and just add your situation has not changed, maybe best to wait then to see if they sell the debt on as got a better of chance of settling the debt then.

                          hope your doing better now by the way, i too suffer from panic attacks, its not nice.

                            I like your enthusiasm, but you need to be mindful that some of the suggestions you have made may not be suitable depending on Nattys circumstances (which you're not aware of). For example:

                            Email them and just tell them how much you can pay
                            You ONLY do this if the intention is to negotiate a settlement or payment plan. By doing this you are resetting the Statue Barred clock, and this means that a creditor can continue pursuing you. If the aim is to get to 6 years of no acknowledgement of the debt, or payment made then you're shooting yourself in the foot by making payment offers

                            Lie if you have to and say you are on the sick from work and you are not on full pay
                            You shoud never lie - if (in the unlikely event any action gets to court), then lying is only going to server the creditor in painting you as a dirty debt dodger. When it comes to payday loans, there are plenty of other ways you can get them by the short and curlies that won't involve lying. In Nattys case, the PDL company have already broken FCA CONC guidelines by refusing to put the account on hold while she obtains financial advice- that is enough to right now to put them on the back foot, and raise a formal complaint. If then (in the unlikely event it ever got that far), things got to court, then Natty could argue the unfair relationships provisions. If she lies, and a Judge asked to see evidence of long term sick on reduced pay (which doesn't exist) its not going to help
