    Wonder if anyone can help with this – sorry it's so long.
    I know a taxi driver who rents his vehicle. He had a car accident in this vehicle and the other party immediately admitted fault to it. The taxi rental firm referred him to a claims management company so he could claim personal injury. He had a medical submitted to the insurance co and then later received a cheque in his name to his address. Problem was that on the letter attached to the cheque it stated please find enclosed the sum of xxxx for repairs to the vehicle? He thought that bit must have been a mistake so put the cheque in his bank and let it clear. Two weeks later he got a phone call from the claims management co. to say he had been sent that cheque by mistake it should have gone to the taxi rental firm as they were the owners of the car. His offer for personal injury had not been received from the insurance company yet. By that time, he had spent some of the money so this caused hardship. He told the taxi rental firm that he would write out a cheque but they insisted on receiving the cash and he obliged. Now a few weeks later he phoned the sols dealing with the claim and was told by someone in that office that the personal injury offer was now in but it had to wait for the return of the person dealing with his claim to accept the offer. He phoned her the following week to say he wanted her to accept on his behalf. She initially said she did not want to accept that yet as there was a dispute about a part of the claim in relation to the loss of hire monies and she would need his cooperation at a later date with that . He explained that the loss of hire money was nothing to do with him but the taxi rental firm. She then said she would except the offer on the system but it could take 2-4 weeks as there were delays with receiving the cheques. So he waited. He rang several times and she said we accepted the offer but your cheque has not arrived yet. So today he said to her, I will telephone the insurance company myself but she insisted they would not talk to him as they had to deal with them only. He did phone the insurance company who were happy to talk to him. They said your offer has not been accepted yet but when it is we are obliged to send the cheque within 10 working days (no delay of 2-4 weeks). He told them about receiving the wrong cheque and they said, they had not made a mistake – the cheque was his as he was the owner of the car. He explained he wasn't but was told to take it up with the claims management firm. He went back and forth and the sols continued to say she did accept the offer but they have not got back. The insurance company continued to say she had not. He told her what the insurance co said and she said there must be some mistake on their system. Eventually, after numerous calls to both companies she said I have now emailed the company and they will release the cheque – you should receive it by the end of next week – she even said she would post it out special delivery once she gets it. Just before closing today he rang the insurance company to ask if they had received the email and would they now be releasing the cheque they said – no email received yet. So it seems she has been lying all the time.
    I have told him to send a written complaint to the sols, copying to the insurance company, detailing everything that has happened and state in the letter that he recorded all the calls to both companies and will use this in his complaint to the legal ombudsman.
    Does anyone have any ideas what is going on here? Thanks in advance.

    yes, simple case of left hand doesnt know what the right is doing, and people claiming to do one thing and dont, or do another.

    Its a shame, but these things happen sometimes, and the only way it gets sorted is by bugging the hell out of them until they sort it out.

    Ive had similar issues with other companies regarding other things, namely saying they will do something and never do.

    These people clock off at the end of their shift, and couldnt give a monkies whether something has been followed through they just assume someone else will sort it.

    What your taxi driver friend should do, is take the name of any person he has dealt with, so he can always throw it back at them whenever a complaint is made, otherwise they will deny it was ever said.

    Another thing is these companies record conversations, so make a note of the date and time of every call, incase you need to request the info on what was said.

    If your friend feels they are getting nowhere speaking to the lacky manning the phones, demand to speak to someone higher up who can sort it.

    Other than that, its really up to your taxi driver friend to keep bugging them and writing letters threatening action with an ombudsman until its sorted.

      and he should be assesrtive, he shouldn't allow himself to be palmed off my a dumpling on the phones and always get their names and cubicle number.


      I also find that calling peeps "young man" or "young lady" really upsets them..........................

        Aww thanks to you both for reading and replying. He rang explaining he would be writing a formal complaint. He also mentioned he had recorded the telephone calls (he hadn't) and would use these in that complaint. Lo and behold within 20 minutes he had a call back stating it had all been sorted now. He has sent the written complaint anyway! Thanks.
