Just as a confidence boost this one, not really expecting any replies. For those who've given up on the whole bank charges issue, I've just managed to help get somebody well over £1000 of charges back plus £50 for incorrect default. Don't give up - keep at them.
If it's of any help to anyone, what I did was write a letter. However, before doing so I identified every little point where the bank had gone against good practice and my opening paragraph asked them to justify each point individually. I then went through point by point their failings and ended each paragraph, "bearing in mind OFT Guidance, the Lending Code and a whole raft of other legislation I could mention, how do you justify this as a supposed responsible lender?"
I didn't overkill, but put in enough to well and truly hang them, and by posing the question after each point and asking them to respond to each point their only answer was, "We can't justify it."
Hence the refund.
Keep persisting. They expect you to do as most people do and give up at the first hurdle - don't! Equally, don't waste money pursuing through the courts. Cost of stamps is one thing, court action is different altogether.
