Re: Pepe2008 Heading for the Sun!

    ,,,,and todays Comedy of Errors...

Moroncroft.....sent me a letter thanking me for the £1 payment , but ' we need to agree a proper blah, blah....that would be the £1 Statutory Fee for the CCA Req that they have failed to respond to. They claimed that I had sent it with no letter....erm, how did you know to apply it to my Account then? Or did I win a lucky dip?
Pointed out the error of their ways and will be confirming it al in writing as a Complaint.

    Mercers.
Suddenly, with no previous warning at all, a 6'2" African appears at my door. Are you '...'? he asks
Who are you? I ask....'Resolvecall' he responds.
I repeat the question several times with the same result....a bit like tennis, but more intimidating.
No ID offered at all, at any point whatsoever.
I tell him to wait for an hour while I find out who Resolvecall are. He retreats to his car....which is parked on my neighbours ( wholly enclosed) property across which one HAS to go to get to me.
I go out to ask him to remove himself whereupon he gets abusive and threatening and even tells me to fuck off ( ..HEY! Thats my line!)
Complaints to Mercers and to Resolvecal followed....especially as this twat eventually said 'I'm a Bailiff'....bingo! A full set of Offences.
Btw, the Account concerned is 'In dispute' and has been for some time. Still, good to blow out my frustration with the traffic on a Friday.
Wine being opened now. ..nd then will be discussing the matter this weekend with my neighbouring allotment holder, who is a High Court Judge...and maybe give the 'callers' car reg to the Police.....anything else to do???

Keep in touch then, feels wierd to drive through the Village and see signs pointing to the next village and 'Espanha'.

Blimey its cold.....just got back from 26C and blazing sunshine...seem to have bought a Farm !

Back to letters from Tryiton ( Style, no PT's ) and the Scouse Gits (Bcard, no CCA yet) so have sent them Threat-o-Gram letters back.

...and Moroncroft making threats about Bcard, which I am ignoring as there is a CCA Req in place from 10 days ago.

Other than that, all quiet on the Western front....and with an Account with a Local Portuguese Bank who pay 4% interest and will transfer money back to the UK for only 4 euro, I know where my money is going

Be a few months yet Nid, need to deal with the inevitable paperwork as and when it comes in for then.

So far only have a small amount that is enforceable and they are the ones that need to be bounced along. The others can go whistle but they'll need to have it proved to them in the meantime.

do us a favour mate and don't tell them your new address.... no offence but I'd rather not have you here posting about debts when you're meant to be living the dream in Portugal.....

Forget the past - look forward to the future

Obviously stay and post normally etc but just drop the debts

Didn't use the 'Account Sold While in Dispute' Template but I did add...

Since early 2011 your Client has failed to provide a true copy of an Agreement in this matter. You may not be aware of this and that, I presume, is why you have sent me a threatening letter regarding it before you have correctly established the facts ( which, I believe, demonstrates a dereliction of your Duties under the Terms of the Office of Fair Tradings’ Guidelines on Debt Collection). Before you send me further such letters, so compounding your offences in regard to the OFT Guidelines, you may also like to address this lack of a true copy

    Therefore…..

....in between the Account Ref and the meat of the Formal CCA Request Template.

    Hope that was OK.

Re: Pepe2008 Heading for the Sun!

    Dear Sirs,
    Your Reference;
Your letter of 6th February 2012 indicated that you ‘are urgently trying to contact’ me, I believe that a LETTER IS CONTACT.
You then go on to make several threats indicating the seriousness with which you may treat the matter.
However, my letter of 09 February seems to have been ignored.
I find it difficult to believe that you should actually write me a letter telling me how important it is that I contact you, but fail in that letter to expand on the reasons for your overwhelming desire to ‘contact’ me and then totally ignore my letter sent in response to your tirade of threats ( peppered with ‘may’ and ‘could’ ) which in itself may well be in breach of the Office of Fair Trading Guidelines on Debt Collection . From the list of threats you make, it is quite clear that your letter is a computer generated general Threat-O-Gram and bears no relation to the particulars of the matter concerned and is purely designed to intimidate and cause distress.
You therefore may consider carefully your response to this letter as it may well form the basis of a Formal Complaint to yourself, the OFT and ultimately the Financial Ombudsmans Service, but first of all I suggest that you reply to my letter of 9th February.
    Yours,

...that was the text of a 'playing' letter I'm sending to someone with 2 good CCA's on my 2 Accounts totalling about £5500.

See how long it takes them to realize. Then I may start using Niddys templates....
