Shoosmiths, judging by their letter I received today, have taken a leaf out of NW numpties book by suggesting that I should "sign or pay up"!!! They know better, sig not required and all that. They've included a copy of the form sent to me where NW have ticked a box saying "...we require your signature before we proceed..." I have seen this from them about three times so I didn't really need a copy. I'm tempted to ignore this now because, to be honest, I'm getting really bored with the whole repetitiveness of this particular saga... unless anyone has any better suggestions?

Received a letter today regarding my BC account from a new crowd (to me anyway) called Horwich Farrelly Solicitors in a distinctly RobWay looking format. The letter said that they have received instructions from RobWay to "claim from you full payment of this. Looks to me like standard bullsh*t but I thought I'd update my diary as it's been a few weeks and see what everyone else thought....

They must honestly think that the people on the receiving end of this drivel are as daft as they are. You'd think that they would be capable of using a different font on the pseudo-licitor letters, just so people might believe for a moment that the letter has come from an independent organisation. Instead, these pathetic amateurs just flag to people that the so-called "account" has only been passed to the threat monkey on the next desk.

Without seeing the exact contents of the letter I can't say whether or not it could actually pass as a genuine letter of claim, but it will probably need a counter of some kind just to maintain the paper trail.

if it's just a stupid mailshot, I'd pop off a sold in dispute

if it's a letter before action, then it needs something else

              let us know

I cannot be positive but from the evidence, I would guess that there is a bit of fishing going on here. The addresses of the two organisations are exactly the same, the telephone numbers have one digit different and, to cap it all if I was in any doubt, the payment details are exactly the same!!

Latest offering from Shoosmiths on my NW account that they're demanding my sig on a CCA request; basically another pay up or else letter. Another I&E form attached to be completed and returned by no later than 6th December. They state a cheque for £1.00 is included as they have not received my signed s77/78 request; there was no cheque with the letter. Any action?

You'll need to write back with the following --> Our Templates | Unenforceability Templates | Signature Request - Formal Response

Obviously add a line and mention
"the cheque I previously sent remains in your possession and was not returned as directed in your letter. Please use this cheque in payment to supply the requested information"

Sent the letter that Niddy suggested and they responded by sending me the same letter as last time with only the 'respond by or else' date changed to the 13th December. This time, though, a cheque for £1.00 is attached to the letter. Not the one I sent, though. It's a Shoosmiths one. What to do? They really are starting to get on my nerves now!!

Have they done this? Make sure you check the quoted balance to see if there is a £1 difference anywhere. Crapbot pulled this stunt on me in 2008, but even they had to back down following a formal complaint.

As for Shooshits, they are just being facetious. I honestly wouldn't write any more to them than just a simple three line letter referring them to the last letter which they should have bothered to read. I'd send their silly cheque back to them, without even bothering to explain why as they know bloody well why already. They are just taking the wee and trying to wear you down with repetitiveness.

"I am in receipt of your letter dated xx/xx/xxxx.

I refer you once again to my letter of xx/xx/xxxx, which appears not to have been read or actioned.

I have returned your cheque for £1.00."

No, they haven't cashed the cheque against the balance. I've just checked and the balance hasn't changed in 8 months.

That response sounds spot on and to the point. They obviously haven't read the letters that I have sent which you would have thought would be part of their job! I'll send that response off recorded tomorrow

My Amex account - I received a settlement offer which I politely ignored. They reminded me of this offer which, again, I ignored. I then received a NOTICE OF REFERRAL TO EXTERNAL COLLECTIONS AGENCY letter. A few days later I received a "pay up or else" letter from Moorcroft. I presume that it's the Our Templates | Unenforceability Templates | Account Sold whilst in Dispute that is the response that this should get?
