    .....of interest to me is that since my response to TM I am getting hit hard with withheld numbers - with only this account seemily active at the moment Im relating the two. If they are indeed going to court this doesn't seem like a tactic they would use - pure guess work of course. My account that did, threatened court and then did it without contacting me again.

    Anyway, good luck my friend.

      I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website.         Best of luck matey - remember, offer around £2k or £50 per month, whatever - but remember it has to be fair in line with other creditors so say you have 10 debts at £10k each, you cannot allocate a higher amount to this one account so when you make the offer, emphasise the fact you have several other debts (and list them) and mention that if they fail to accept the F&F then you'll have to put them in the queue with the others and therefore pay them X amount per month, forever!

            Well as it looks like I have blagged the Egg account for as long as I can as it is considered enforceable.
            In view of the letter I received with the threat of the imminent issue of a county court order, and discussions with Niddy, I bit the bullet and called Trevor Munn solicitors, who ARC credit management claim are their appointed “solicitors”, well I thought I was calling Trevor Munn, in fact as it turned out it was ARC credit management who answered the phone, ARC who are acting on behalf of Egg Banking, and Trevor Munn “are one and the same”. So, usual misleading tactics by a DCA to lead you to believe you are being contacted by an independent legal firm.


            Anyway, to avoid the possibility of the account being passed to county court for litigation, I told the call centre representative that I was calling to let them know I would be making an offer within the next few days, after a somewhat strained conversation (which was also a little funny at times, as when he asked me for a contact phone number, I said I was calling from a friends, I said I didn’t have a phone, as I was hard of hearing, to which he responded by shouting everything down the phone at me..)

            So as the conversation continued, he tried to get me to give him my debit card details, and he tried his best to get me to commit to an offer there and then, and he also wanted me to go through an income and expenditure survey there and then, needless to say he was unsuccessful on all counts.

            He eventually (but reluctantly) agreed to put the account on hold which would delay any intended county court involvement for a week to give me time to make an offer in writing.


            I was a little undecided, on whether to make a low full & final offer on the account or try for a low monthly repayment plan.

            I have decided on making a very low F&F……which will be £8K less than the outstanding balance as it sits right now. I can’t see them being very happy with the offer, but we will see what their reaction is.
            Watch this space...
            Ok two letters received today, (both showing same date) from ARC Credit Management in reply to my F&F offer to Egg. The offer I put forward was for £2K (the balance on the account with interest currently sits at £10,336.

            Letter No1 states, "In order to accept your proposal of £2,000 in short settlement on the account, our client has stated that they require you to provide a full financial statement clearly showing your financial situation with your incomings, outgoings and list of creditors.If we do not receive your finanacial statement within 14 days,the offer of payment will be rejected and this account will be passed back to our solicitors for further action"

            Letter No2 states, "We refer to your recent offer to pay and confirm that we are willing to accept £6,300 to settle this debt, so long as payment is made in accordance with the following terms: Payemnt 1: £6,300 by 30th April 2011"

            A little confusing to say the least.. ...

              I Did not respond to above letter.

              Today I received a letter from Nelson Guest & Partners Solicitors.

                They always say they require an I&E sheet - if you can "fudge" one then it's worth sending lol

                    RBS have sent what they say is a copy of my CCA, but to my untrained eye, it looks nothing more than 5 pages of T&C, there is nothing on the "agreement" signed by me or RBS.

                      You could play silly buggers and write back just saying you require sight of assignment deed prior to communicating with them, otherwise you'll continue to communicate with the original creditor, RBS. See what they say to that!

                      Although, we both know they have not been assigned the account, they have simply been asked to pursue the debt on behalf of RBS so you could do the above; or just send this instead (you decide): ---> Debtors Final Response - CCA Received

                        Thanks for the super quick replies niddy mate,
                        Will send off response letters in the morning for the RBS & LTSB accounts..
                        Will think things over for a few days in respect of the Egg offer.

                        I may well construct some sort of Financial statement, and once they see there are a whole bunch of card creditors all wanting a slice of my "paltry" income, it may well slow them up a bit with their demands !
                        Like you say, if fair to one then got to be fair to the lot of them, which will mean there will not be a lot to go round.....

                          Done a financial statement of income and outgoings in response to Eggs letter requesting one in order to consider my F&F offer
                          Egg balance just over £10K, my F&F offer of £2K ! (cheeky yes, but hey tough times, and they have had their capitol outlay and profit back in interest over the years !)

                          If they refuse the offer, then I will have to look at a repayment plan which will last until I have a long grey beard or am six foot under !

                          I'll report back on this one when they respond to the offer.

                            Cheers mate, keep us updated - I hope £2k isn't the maximum offer lol, usually we start low and have reserve to make it higher so if you had £4k then i'd suggest starting at £2k, then haggle in blocks of £200 until they do accept.... everyone accepts at some point, they just don't know when that will be!

                              Update 03-05-11
                              Barclaycard (Formally Goldfish) current balance £8,541.12

                              Having heard nothing more for quite a while. Today I received a letter from Credit Solutions Ltd.

                              "We act as agents for Barclays Bank plc trading as Barclaycard. They have informed us that you have not complied with the default noticem they sent to you. The balance stated is now due in full, and Barclycard demands that you must pay this immediately. (Envelope for your payment is provided) How thoughtful
                              Statements will no longer be sent to you (Not had any statements for months) and interest will be charged on the outstanding amount at the rate of 1% per month."

                              So looks like Barclaycard are still hanging on to the account and still adding interest !
