Obviously an OD is CCA Exempt in the "traditional circumstances" so eventually you need to consider repayment or blagging it and holding out for statute barred (ie 6 years) - so if it's easier for you to pay into it then do so, if not be prepared they will add charges etc onto it, but usually we say let it default then make a F&F offer with the DCA for around 10-25% of the actual balance so really, yea it's best to ignore OD demands.

For the small balance anyway, they're not likely to risk taking it formal.

Had no response re CCA requests sent to MBNA on 09/09.

Re Co op loan. I've got original agreement and was sold PPI on this. £1,118. Also do i need to send CCA to them and Metropolitan (HSBC LOAN) who i've still not heard from since we cancelled th dmp. In fact i never hear from them. Must be at least 3 or 4 years

No it's just one loan. We borrowed £5,000. Insurance was £1,118. We now owe £4,100ish. We were on the dmp 8 years and stopped paying about 3 months ago intending to br until we found this site

Sounds interesting especially as i'll find out this week if i need another operation. Really could do with making life as stress free as possible at the minute. Will they delete old numbers tho or just revert back to them? Mind you they're not getting any response at all at the minute so guess not. Yep sounds good to me. Thanks

This is totally unenforceable - they've only sent a copy of an application, no terms or anything - they will probably make a recon, but as things stand - this is

Respond with: ---> CCA Query - Application Form Received

                            Well done

With our system, they'll be able to leave a message ergo they cannot remove it again and revert back as they are not being ignored - if they did that we'd get them, that'd be a breach as they cannot just change numbers to suit.......

Point is, you give them one of our numbers and then we'll forward messages to you with a suggestion of how to respond, thus you'll just omit the possibility of ALL calls......
