    I would just ignore for now.....

      That means they're in default of your cca request so they can't take things any further until they provide you with it. Like I said before, just ignore them and wait for them to write.

      If the texts are bothering your hubby, could he change his number? I know you've already sent the telephone harassment letter to them.

        Thanks. Got a feeling this one's gonna get messy. Others dont seem so bad cos they're just unknown faces in an office somewhere but think these will speak to us one way or another. Thanks for the advice,we'll ignore as you say and see what happens next

          Try not to worry about it. You've got the help and support from us on here. They are not allowed, by law, to harass you.

                I2D and pixie are right here. However if you are feeling this is a threat and a problem to you, try this for one:-

                If there is any more nonsense like this then we can up the ante with the next letter.

                You say they are regulated. If they don't behave and send your CCA then we can probably push them into a corner whereby they commit a criminal offence by not responding correctly.

                  Thanks Garlock. We're going to do as advised and follow the procedures as we would for any other creditors and see where it takes us for now. Do feel a bit intimidated i have to admit but i'm sure they've got a lot more than us to lose if they dont play ball.

                      Trust me, just sit tight and await CCA...... after 16 days have elapsed update this thread and i'll then sort the next move with you.

                          Thing is they are likely to have a compliant agreement so I do not want you to start making enemies unnecessarily if you see what I mean? This is too close to home and regardless of me sitting here 500 miles away saying "legally this and that" - we all know some of these local doorstep lenders can be a right handful so it's best to just ignore the texts and see what they send/write to you. If they happen to ring and you answer, just hang up without saying anything at all.

                          You'll be fine but we have to play by the book - just in case.

                            Just to clarify, Garlok's course of action is correct however I am just saying, as I know more about this than others due to contact with the OP - I think it's best to deal with the non compliance of s,78 and deal with any harassment issues separately. Ergo for now it is best to get them on the CCA fault, then we'll see what that produces.....

                              Received a letter from Reliable re Simply Be. Says my conduct is unacceptable and will not be tolerated. I've had the goods and made little effort to pay for them. They're assessing my account to pursue legal action.

                              Letter from them re Ambrose Wilson about home contact on Wednesday. Both accounts are UE and had letter from JD Williams on 14/10/2011 stating this.

                              Letter from Lowells re capital one saying they may be able to offer a greatly reduced settlement. Balance is £123

                                Reliable - write back and say "excuse me? How dare you write to me in such a manner; YOUR conduct is totally unnecessary however unlike me, you are regulated and as a result of your downright defamatory letter I am reporting you to your regulators starting with the FOS"

                                That will shut them up. Idiots!!!
