      Unfortunately yes, you ought to think about repayment proposals as s.127 does not apply

      Failing that, if you've no chance of ever paying it and do not own your home, consider alternatives such as more formal things, i.e. an IVA may be better, BR may be better - I don't know but all I'm saying is that to repay £28k will take a few years

      If more than 6 then surely BR or IVA is the obvious choice? I dunno, I'm just saying you do need to think long and hard over this before paying a penny back......

        We tried going for IVA but no good as N Rock insisted if we went interest only mortgage the extra cash would mean we could continue to pay off debts. MInt Loan never cast their IVA vote so it was all down to N Rock! That's why we ended up here with you guys as although we went interest only the creditors kept adding interst and charges so the six years we could pay it all back in was looking more like 15 to 20 ! And now the interest only is up and were paying full mortgage again. Guess with this one we can do a deal with the collections agency at a better rate than if we were dealing direct with creditor. what's best way to start this ? Do we make an offer of payment as not got enough cash to do F and F yet.

          Regards to making an offer, there is a forumla of letters as found here (on our website) ---> allaboutDEBT | Our Templates | Creditor Offer Templates

          You basically use that to work out F&F - however you're after monthly payments so you need to consider this collection here: ---> allaboutDEBT | Our Templates | General Debt Templates

          However if necessary we can line you up with our dmp specialist who may be able to help you out more...?

            All help welcome. Is it XXXXXXXX we need to get hold of. How do we make pro rata offer if some debts are ue and one we still have no cca for so could go either way. Do we base it only on the enf ones for now. Happy o take your lead, XXXXXXXX on how best to proceed. Cheers

                  21st July 2011 Received letter stating under S78 they are compliant if they provide a true copy......that there is no obligation for them to provide a copy of the original agreement bearing signatures....no reason to enter further correspondence with us..do not consider account to be in dispute ignoring
                  17th August 2011 Received Mint card statement still zero interest added
                  14th Sept 2011 FINAL DEMAND pay up in 14 days else pass to dca
                  15th Sept 2011 Statement still zero interest
                  18th Nov 2011 Received from WESCOT - RBS instructed them to take over balance on this account
                  27th Jan 2012 WESCOT ..FINAL NOTICE ..latest enquiries have now confirmed you are resident at address..unless contact within 10 days further collections activity will be taken ..may include legal action..door step collections visit
                  31st Jan 2012 sent the Sold in Dispute Letter cheers I2D
                  16th Feb 2012 WESCOT - have contacted MINT and have been advised they complied with request on 30/06/11 - WESCOT believe dispute to be resolved and full balance or agreed monthly instalments are required.....blah..14 days to contact them if we still believe valid dispute else will pass to recovery team.
                  09 March 2012 NELSON GUEST SOLICITORS on behalf of wet cloths!!..unless full payment or repayment plan in 10 days, further recovery action WILL be taken.
