    That's looking good. If your M&S card was upgraded to a CC then ; HSBC, what a shame and let's await Niddy.

      I just realised that the letter about HSBC came on a letterhead from Idem, but is in fact being 'managed' by Moorgate. There is definately a bit of a cockup on my paperwork!

        So to update:

        HSBC

        MBNA Virgin

        M&S card

        Good result so far. I noticed on my credit file that both HSBC and Moorgate have placed a default for the same account. Not that I am worried as they all fall off next year, but should I do anything?

            Keep the letter saying that they can't find the agreement very safe

                29/2/16 - Letter from Robinson Way dated 24/2/16.
                We have received notification from your authorised representative that you are no longer dealing with them and ask you to kindly complete the enclosed financial statement, including and offer of repayment based on your affordability.

                We will place your account on hold for 30 days whilst we wait for your response. If you require help or advice, dealing with your financial difficulties, there are several organisations that offer free impartial advice.

                Do I ignore? I thought this account was with MKDP, not heard that it had been transferred. Its an old business barclaycard.

                  They seem to be wanting a confirmation from you by replying that the alleged debt is yours .If it were me I would see what they send next,
                  unless someone says differently.xx

                    As I had no response for my CCA request from MKDP, I have today sent off a CCA request to Robinson Way. Hope that is the right thing to do.

                      When did you send your CCA request to MKDP? If it's still outstanding you don't need to send another.

                      If I'm not too late to say this, don't send a CCA request to Robinson Way, you should send them the SWID letter.

                      Have Hoist now been assigned this debt (since you sent MKDP your CCA)? If so they may not know that you previously sent a CCA request to MKDP. They will if you tell their agent DCA Robinson Way.

                      Always assume that the new owner of a debt knows nothing of the history, because they probably don't.

                        If it's a business credit card, is it in your name (as sole trader) or in the name of a limited company?

                        Your post says Robinson Way were dealing with your "authorized representative" which may mean a DMP. If so the creditor must still send all statutory notices to the account holder (i.e. you). That includes any NOA.

                          It's in my old business name that I no longer own. I don't recall receiving anything. I've CCAd them. This was on my DMP and regular payments were made until January when I was going to change to step change, then found this fab site, and cancelled all payments. £700 outstanding but already paid over £500. This is one of my smallest debts.

                            they may have sent me an assignment letter, because I didn't want my husband to know about my debts, I shredded everything I received in connection to all my debts. It's only this year that I've started to take control of them having used a DMP company for the last five years.

                              Today I had a response from the FOS in response to my complaint about the cooperative bank and my business overdraft. They basically said the bank has treated me fine and I had no reason to complain. I have sent the response to Niddy, to see if I can do anything more about it. I haven't heard from them since January and they hadn't replied to my overdraft CCA request sent on 10th Feb and signed for on the 11th Feb. I'll await to hear from Niddy. This is the only debt that I'm worried about as they also hold my mortgage (although it should be paid off later this year) and have already threatened me by letter that they would instruct their solicitor to place a charging order on the property.

                                The fos are kinda right. Why didn't you send a statement when asked? However, I'd not worry. If they issued a claim you could resolve this at mediation or at least admit the debt and offer a Tomlin deal (ie no ccj) so it's not worth overly stressing about.

                                Just sit back and await a reply to the CCA.

                                I guess you've cancelled your DMP now? If not, then UE isn't for you.
                                That said, if you want them to consider an offer do as they ask and send bank statements. If it helps you - then do it. Also tell the FOS you want the £100 as offered (better than nothing) and kinda argue that because you don't have evidence doesn't mean it didn't occur and explain you have more pressing issues than co-op bank and keeping evidence.

                                Regards D a the complaint from 2011 - if you were on the DMP then and DID include co-op (who ignored it) then go to the DMP firm and ask for a copy of your original application for DMP and their letter to co-op. They'll have evidence, surely?
