      I'd just send something like this -

      “Dear Sirs,

      I am in receipt of your letter dated xth January 2013, in which you state that you “require £1 payment to process my request for copy of agreement”. Note that I have made no such request.

      It should be obvious from the content of my previous letter that a formal request pursuant to Section 78 of the Consumer Credit Act 1974 has already been forwarded to the original creditor, and has been received and acknowledged. I therefore have no reason to submit another one.

      Yours Faithfully”


      I would just leave it at that. Let them go back to your previous letter and actually try to read it this time. They will no doubt come back with “OK pal, if you've already made a request and received the documents, give us your money”, to which we'll reply “Sorry, guv, not enforceable”.

      What you would want to send, but shouldn't, is this -

      “If 'RTFM' means 'read the manual', then 'RTFL' must mean 'read the letter'.

      RTFL

          I will get that letter sent away as soon as ,I couldn't have put it any better ,you know how to deal with these people I'm learning very slowly.

            I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website. I am extremely busy so if you do contact me or need a reply to a forum post then use the email or PM features offered because I do miss things and get tied up for days at a time!

                Sorry Never in Doubt but I had already posted the letter that Scabhunter had kindly drafted for me ,( I would have opted for the more polite one !!!!) thanks for your input much appreciated and did make me chuckle .

                  A little combination of Niddys well thought out and eloquent passage with the addition of SH's final paragraph would have been my choice, but then, I'm not known for being tactful OR for being ladylike

                        July 9th Received letter requesting PO to process my request foy CCA agreement

                        July 11th Posted one liner letter to moor croft regarding " my cca request" ( which was actually the sold in dispute letter !!) informed
                        them to take a look at my letter dated 3rd July



                        December 11th received letter from Moorcroft stating to prevent further action send payment proposal to them


                        December 14th Sent letter stating to look at letter I posted to them on the 3/7/12 also sent a copy of said letter

                        December 22nd December ; Received letter stating in order to stop our recommending our clients that further debt recovery action be
                        taken we can confirm we are prepared to accept a sensible monthly repayment plan an example of what we would consider would be £120.00 per month. I need to respond in 7 days ( oops!!!)

                        December 29th. ; Received a reply from Moorcroft to my letter dated 14th December ."in order to carry out your request for CCA you
                        must provide us with a £1.00 fee!!!". I sent them " account sold in dispute" letter


                        January 17th: Received letter from Wescot acting for Sainsbury looking for payment of balance

                        January 22nd: Sent "sold in dispute " letter to Wescot
                        January 26th: Received letter from wescot stating they have now confirmed I am still resident at this address !!!!! (doesn't make sense) but we have not received a reply to our previous correspondence .

                        If I don't reply within thenext ten days they will proceed with further collection activity . I did write to them do I presume that our letters have crossed in the post and ignore or send another letter to them?

                          If it was me I would ignore. If you only received this on the 26th, it has almost certainly crossed in the post with the one you posted on the 22nd. DCA post tends to arrive slowly, for more than one reason. They use cheap services, and they are also fond of using a dishonest technique where they give the recipient a deadline knowing that the letter will arrive too late for them to respond in time.

                          It is just another routine threat. What does "further activity" mean, anyway? I'd just leave it to see what comes next.

                            I didn't get too stressed with this one (Is that a good sign??) I did think the letters got crossed in post, I just needed confirmation from people in the know .

                              Its just bullshit weasel words intended to frighten you that they have been 'investigating' you. Think about it. Confirmed with who? They could have confirmed it with my dog for all you know

                              Further collection activity - aka send another letter

                              Letters definitely crossed in the post. Wait for a response to your 'sold in dispute' letter. If you send them too much correspondence you will overheat their braincells

                                Now that you've pointed things out to me it I can see how unprofessional the letter looks ,perhaps their brain cells are already overheated!!!
