    Yep that's probably the best thing to do mate. Never miss a payment with the CCJ or they can then go for a CO which is harder to fight.....

      Theres a section that asks for other debts, do I list my 3 other defaults and big debts? and should I list my income from rent on my house, will they deffo know about my house as I have had a different address for a few years now...

        Sorry it's not a good outcome mate, but then we knew you were blagging for time - they win this hand of poker I'm afraid.

        However you can take heart from the fact at least when it goes formal their hands are more tied so they can't take the piss. Just pay the agreed amount and no-bugger can touch you or the house. The CCJ can sit there being paid for 10 years, so long as you don't miss a payment there's nothing they can do.

        However a £65 per month offer would clear a £5k debt in approximately 6-7 years so if you ever do get the chance to pay more then I'd certainly try to otherwise just leave a simple DD running for the next few years.....

          If you're asking me whether you should lie on an official form mate, I have to say no - not on your nelly. However before completing it why not ring them on Monday and ask the question "would you stop the action if I set up a DD with you now for £65p/m for 6 months and we'll review it then" - ideally the more you can afford each month, the better it is for you.

          You mention the other bigger debts, are they enforceable or not? Just remind me of the debt balances? Thing is if those debts are bigger then you could argue against the CCJ based on preference over other creditors but that's not something I would suggest to be honest. If you can, try and reach settlement direct with the creditor/claimant of the N1.

          Does all this make sense mate or do you need anything explaining in greater detail - ask away, but whatever you do DO NOT touch those forms until you are 100% happy how you're moving forward with this.

              Ok well lets wait and see what happens yea? If you end up with more CCJ threats then you may need to consider other options so keep on top of things.

                    Omg now I have received a pack with all my spending on the Barclaycard, this is the type of thing I got before my recent threat of ccj on the other....Niddy you did say this Barclays one was unenforceable, and they do say they are awaiting a copy of the agreement from Barclays, but I am quaking in my boots and really worried with this and the form I have sent off...

                      Calm down!

                      Barclays - wait and see what they send next. Regards completion of the N1 have you done that yet? If not its up to you.

                      Do nothing and they get default judgment - then wait and see whey send you and if the amounts are too high then you look at redetermination.

                      Fill in the form, you need to do an I&E now.

                      That's the two options mate. Same outcome but different ways of dealing with it.

                        Hi m8, I sent the form first class yesterday...just hope the accept monthly payment, the Barclays thing is really scaring me as this is what happened before this other ccj, but you did check it and say it was unenforceable and the debt company say they are waiting for the credit agreement from Barclays.

                        Just before Christmas both these arrive, have they had a meeting on me or something? guess the other 2 will be back in the new year, winter deaspair...oh yes!

                          Barclaycard's DCAs are using this as a standard trick now. We had it from wescots in the dying days before they sold UE accounts to Lowells. Its done to try and make you believe thats they have all the aces and kings. Just file it away and froget as Niddy says until they do something serious.

                              Really struggling sleeping at the moment, keep thinking the unenforceable ones will go down the same route in the new year, and my house and all we be gone...its also my birthday today so best cheer up, ah well just thinking out loud...hope you've all had a good one...Happy New Year!
