      Its just that i've read when people get Ccj's they can then enforce the debt, and the baliffs can take the car etc...also I work for a friend at the minute and would he find out about the ccj, it would be a big embarrasment...(thats your fault crisp man!).

      So have I just to leave the package I have received, and let them do the ccj?

      Off out soon on all dayer round York, I best try and dodge some rounds as im going to need every penny again...sigh...

        Mate fuck knows where you've been reading but suffice to say id stop going there!!

        Of course if you have a judgment and do not pay it then they can try and escalate it to hceo's (bailiffs) but do long as you pay the account they cannae do bugger all mate.

          mate I did that yesterday and it's bloody expensive in York!!! Although I do like the Maltings. My head is sooooo sore today

                For a £5000 debt offering £70 to £100 they will probably bite your hand off. £20000 ccj Iam paying just over a £100 so dont worry.

                  Yep feeling pretty terrible today after the day sesh and this new turn of events...cheers Niddy for all your words, it does calm me down a bit...

                  So do I not do anything and let the ccj happen or fill in the form admitting the debt and give them a monthly figure I am able to pay?

                    Very interesting to read through the process but one thing from my case may be relevant.

                    Whether enforceable or not, whether full and final or not, your record is screwed so it would seem logical to actually get it defaulted ASAP and if it has to go to CCJ, to get that over and done with ASAP as well.

                    The six year clock cannot really start until you get this all over with and you could find yourself resetting the clock numerous times and having the whole process taking much much longer than six years.

                        Mate it's cool, stop stressing - I need to discuss a few things first.

                        What do you want? Do you think you can afford monthly payments and if so how much can you pay each month?

                        You can complete the forms online, so you have plenty of time - in any case, if they get default judgment then you can simply apply for redetermination to set an affordable amount if necessary - but stop stressing! I know its easier said than done but really, a ccj when you don't own a house isn't much worry at all.

                              Right mate then I suggest to avoid them trying for a CO - which lets be honest isn't the end of the world being you rent your house out, and they'd never be able to enforce for such a small amount, ie let them get the CCJ by completing the N1 and making a suitable offer.

                              Based on what you've said and the debt I would suggest you go in with an offer of say £60 per month and see what that does. If they reject it as I say you can request a redetermination and provide I&E to the court then they'll assess it based on available income, sometimes it works out cheaper but to be honest as you do own and rent a house out I would urge you to try and reach amicable settlement sooner rather than later.

                              You could try and ring the claimant and see if they are prepared to set-aside their CCJ claim for agreement to settle directly? Otherwise you could try and scrape together a couple of grand and see if a F&F will make them sit up and notice?

                              Bear in mind they know you own your home, they'd have found this out prior to obtaining a CCJ so chances are they're hoping for default judgment thus allowing them to get Interim CO against you thus completion of the forms is necessary but before doing so I would consider whether you can scrape together enough in 7 days to make a suitable F&F or try and negotiate with them on Monday morning to stop action.

                              Its up to you mate - lots to think about, mainly financial related, but if you could get a couple of grand I suspect you might be able to cease action and clear this - but you may need as much as £4k to be honest as to them, they're getting judgment so really why take less?

                                Cheers Niddy, havent got enough around at the moment to do a f&f offer so do you mean I should fill in the admit debt form with income and expenses etc and offer £60 a month?
