Well Capital One really wont give up, this account has been unenforceable all along and there was nothing from them for about six months last year, now they are picking up the pace...

Have now got a solicitors letter! including court costs etc...omg! do they not read all the letters I have sent them?

Capital One have sent the standard "we are looking into it" letter which I have received months before...I guess its a six year loop!

Barclays/Mercers are stepping up the threats and have given me "48 hour notice" so am sending this...

Mercers can safely be ignored usually. However they are likely to send you a red default notice laughingly under "s87(1) CCA 1974. This will be defective. I have not seen a good Mercers DN yet. If you are not bothered about your CRA files ignore it, never speak with these rejects from Chester Zoo on the telephone ---- writing only and never sign letters to them only print your name preferably on the computer. KEEP this DN safe complete with ENVELOP stapled together and marked with date you received it.

They will get fed up with it in the end and hand it over the gangway to the next level of in house thuggery called "Calders Financial". If running true to form they will quite quickly issue you with a demand of some form usually to pay the full amount forthwith. Which of course is invalid until they do issue a valid DN and cannot enforce even in court until they do issue a valid DN. (Don't tell em though)

Even Calders get fed up in the end. and then you are on the outside DCA circus with the rest of us. Cross that bridge when you come to it. Remember it is YOU that is control of this and in Barclaycard/Barclays , my particular obsession (LOL) will go an awful long way NOT to go to court. The threat monkeys starting with Mercers have no legal powers or authority whatsoever. There only weapon against you is your own fear of what they may do which in actaul fact is nothing. Just tell them as impolitely as you like where to go everything in writing only phone down when they call. Don't answer security questions etc.
