    .............you had genuine reasons to complain, even if you did have the documentation!!!
    A rejection just because they were not FSA regulated, and they think you have nowhere to go with this!!

    Don't leave it there, I know Shop direct dealt with this, but the underwriter can be liable too, and were likely to have been regulated, with being the insurer!

    I'm expecting the same now as well!

      .........and to also add, that I would think about complaining to them on way they dealt with your complaint, they've not kept to the "Customer Excellence" name, and surely had more than ample time to deal with it!
      (Now this actual complaint would be regulated by the FSA), it may just make them think, and as a goodwill gesture get them to think about refunding you anyway.

        Sorry for all these posts Cym, but did you get to check the thread over at MSE in regards of Littlewoods, they appeared to be old accounts from the 90's too.

              Apologies for length of time taken to resolve complaint.
              The insurance remains active on my account???? It was closed in 2004! I can cancel the insurance.

              They understand my complaint to be:
              1. Unemployed and could not claim
              2. Underlying health condition which would have prevented claim
              3. Stated was informed would be reliant on insurance
              4. Stated not informed of t&cs at point of sale

              Their findings:
              1. At point of sale would have been provided with main benefits, exclusions and cost before consent to insurance
              2. After sale policy documents were sent to me with all benefits, exclusions, cancellation rights etc
              3. Signature not required as is standard practice in insurance industry, statements every 28 days which showed premium being applied
              4. I have seen no evidence that the insurance was not adequate for your needs or that you would be unable to make a successful claim on the cover if you eat the necessary criteria. I do not believe that your employment status or existing medical condition old have prevented you from making a successful claim on the cover.

              My final response, if not happy may refer complaint to FOS within 6 months.
              However due to the rules and restrictions FOS are required to follow and as your policy was sold before the 22nd December 2003, it kis my understanding yep that FOS may not be able to adjudicate on your complaint as our Company was not a member of the Dispute Resolution Service until this date.

                  OMG!!! you have a strong case and they still can't see evidence that you could not make a successful claim!!!
                  WRONG!!!

                  And what concrete evidence do they hold then to confirm you would have definately made a successful claim!
                  It's a load of bull!

                  I bet that letter they supposedly sent to me will be the same then!
                  That is why they did not want to email it directly to me I expect.

                  I would be inclined to write to them and tell them how disappointed you are with the way they dealt with your complaint, they certainly didnt keep to the guidelines or comply as they should of, the fact that they are FSA regulated NOW, they must follow complaint procedures correctly!

                  They made you hold on lot longer with given extra time to tell you this garbage.

                    Checking back on the docs you posted of some of the key exclusions.....

                    They cannot provide assistance - if an illness for which you have received treatment in the last 12 months, and which recurs in the first 24 months of taking out the cover.

                    If you have not been in full time employment etc.....

                              1997 was then his wife taken her's out.
                              And they were obviously not FSA regulated.

                              Checking on my statement received within a SAR, it was the start of 2001 it appeared on my statements and 2004 was the last payment made.

                                And another thing as well........did they go through the sales procedures with you, or just applied it automatically?

                                If they think they are in the right, then they need to provide you the concrete evidence, just like I mentioned this to them with the additional letter I sent to them.
