  • DCA Change in circumstance

    I agreed with a DCA to pay an amount, however my circumstances have changed and I can no longer pay them this amount. so i am paying £30 instead of £100. They sent me a letter threatning court action because i have not stuck to the arrangement, is this right? i thought only the original debt owed to company can take me to court, and i also thought that as long as an amount is being paid then its ok.

    Debt for £3698 remaining to lloydstsb loan, paying debt managers, threat from Russel Aitkins.

    When did you take the loan out ?

    Was it pre April 2007

      So did you inform them that your circumstances had changed, and why?

      I would point out to them that taking you to court would be a fruitless exercise as they would only be awarded the maximum you could afford and thats what you are offering them now.

      Couple of questions first before you go firing letters off:

      1) When was the loan taken out?
      2) Are you on a DMP?
      3) Do you own your own house/have a mortgage? If so is it joint?

      The consumer is that sleeping giant.!!
