  • What can be included in BR?

    I just went bankrupt on Friday. This is actually the first time I've been debt free for 7 years!

    Something I wondered (It genuinely is just a query, I'm not going to do it!).

    I've been reading I can not get a loan for over £500 without declaring my bankruptcy, but lets say I managed to get one for £50. Something nice and small.

    Even though I got this loan after being declared bankrupt, could I then add it to my bankruptcy form? Sounds a cheeky way to get free money, but surely that would be classed as theft?!

    As I said, not going to do it, I have a conscience, but just wondered!

    No you couldn't really get away with that

    Plus who'd loan anything (formally) to someone currently BR
    I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website. I am extremely busy so if you do contact me or need a reply to a forum post then use the email or PM features offered because I do miss things and get tied up for days at a time!

        only debts prior to BR can be added im afraid, otherwise we'd all get out loans and then include it haha

                Definition of a bankruptcy debt is.

                Bankruptcy debt”, in relation to a bankrupt, means (subject to the next subsection) any of the following—

                (a) any debt or liability to which he is subject at the commencement of the bankruptcy,

                (b) any debt or liability to which he may become subject after the commencement of the bankruptcy (including after his discharge from bankruptcy) by reason of any obligation incurred before the commencement of the bankruptcy,
                In both those cases, a debt incurred after the BR order in the fashion you mention would not be covered.
