    Ok. Just double checking.

    You purchase something over the internet from a major retalier as a Christmas gift - Lets make life easy - a DVD.

    It gets delivered, you wrap it and the recipient opens it AND the case is empty!

    You contact said retalier who state, "tough, you should have opened it when it was bought"!!


    Now common sense says how do you prove there was no disc (which there isnt / wasnt). Obviously with internet DSR automatically kicks as well as SoGA. So my opinion is they are entitled to a refund as goods were not delivered! But there is obviously the difficulty in proving this point.

    Difficulty in proving it is the key. You can get around the "you should have opened it yourself" by saying you did, leaving your friend out of it.

    But that still doesnt prove you didnt remove the disk. Another issue is that its an online sale, if it were in a shop, chances are if you didnt get the answer you wanted, usually a simple, get the manger, will end up working in your favour. But online you cant do this, everyone is just an order ID.

    At the very least i guess, they should, even as a good will gesture, replace the item.

      Why not tell us the company in question as I'm sure if it was a biggie they'd resolve it. It could be a wider issue that involves staff theft - however if you bought from Amazon/play etc which uses a marketplace for any dick to sell their junk then that might be the reason.

      So the retailer in question helps. DSR & SoGA both protect your purchase here. s.75 isn't applicable.

        Suppose I could do! Think of a large electrical / computer retailer and something you enjoy - a good Jalfrezi, after a night on the beer!

        Am going tomorrow with tem anyway, will speak to C Services and if not, Manager - appreciate online sale but same company etc etc. Was aware 75 no use (not enough spent) but was sure on the other two.
