      I second this - It may seem like its a mountain to tackle due to the pressures that they "try" to impose on you however once you manage to deal with them amicably as seems likely in this case then you can relax and plan the next steps

      Once you've got through all this you'll look back and be proud that you got through it all

          The FOS must send anything relevant about the case to either party {upon request}- so just email the Adjudicator dealing with your case and say you'd like a copy of all relevant recent correspondence.
          I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website. I am extremely busy so if you do contact me or need a reply to a forum post then use the email or PM features offered because I do miss things and get tied up for days at a time!

            As I mentioned earlier, although they are part of CasheuronetUK, their actual company head offices are an American company based in Delaware in the US (last time I looked anyway) so this is why sometimes people struggle to get a response. However IF they ignore you (and I have had plenty of experience in dealing with them so know how to approach things so they do not), then this works in your favour NOT theirs!

            This is why YOU send all correspondence via recorded delivery - that way you can prove that you have sent them letters and have tried to sort things out and if they do ignore your letters they will end up selling the account to someone like Arc Europe and then we will deal with them and use this as leverage.

            I know its tough but you're worrying about step 27 in a possible route (not guaranteed that it would ever go that way) on a long journey where you're at step 2.

            You're understandably focused around whats going to happen on the 30th so let me tell you - nothing is going to happen

            They will try to take payment and will fail. They may then try to ring you to pester you for a payment and you're going to refuse to answer security questions.

            There will be little more they can do at that point except send threatening letters. You'll then make an offer (again), and they can either take it or leave it. Even in the highly unlikely event things got to court you'd only be ordered to pay what you can afford nothing more.

            Gone are the days of debtors gaol and being pilloried for being in debt!

            You're doing really well, you've handled things great up to now, so just keep that in mind and we'll all help you through it.

              SnV As you can tell I am a worrier and over exam things, then I look on the web at other people's stories And my mind runs away with me!!!!

              You have the patience of.a saint SnV.

              I am not sorting any other assistance from any other sites, as I do not need to as I have found the creme de la creme site, here.

              I promise I will try and chill and stop over analysing situations.

              Also I am currently back home with my parents and do not want them harrassed, so that is also a reason I am getting anxious.

                OK, lets get started with P2P. You've not said whether you've confirmed with your bank that the CPA for P2P has been cancelled so you need to do that straight away. If you want to send them an email, or take a letter into your local branch, use this (edit bits in red):

                As per the Payment Services Regulations 2009, any more payments taken from this card will be an unauthorized transaction.

                Please send me written confirmation that you have cancelled this continuous payment authority.

                  Ok once you've covered yourself with your bank you need to do the same with P2P. Send this to them via email (edit bit in red):

                  <Start of Letter>

                  [Your address]

                  Loan account number: xxxxxxxxxxxxx


                  To whom it may concern,

                  I write in connection with the above loan which I entered in to on [xx/xx/xxxx], and to request that you cancel the continuous payment authority (CPA) that was set up to make payments under the loan.

                  I have notified my card provider of the CPA cancellation and accordingly no further payments should be applied for under the CPA as per the Payment Services Regulations 2009

                  I would request your written confirmation that you have actioned this request and that the CPA has been cancelled.

                  I look forward to hearing from you.

                    Yes I cancelled CPA with my bank for P2P. I will get an email sent directly to P2P today.

                      Hi Natty - no problem at all - family come first.

                      I would just confirm with your bank that they have done this - record the phone call with them if you can. Belt and braces approach is best when it comes to CPA's.

                      Fab - get that email sent off, should they try then to invoke the CPA you can show that you have contacted them about this.

                              Yes I know all their tactics (unless they have any new ones )

                              You won't get a call on Friday, but they will likely try to call you on Saturday or Monday. If they call you they should ask you to answer security questions and this is what you're going to do - REFUSE TO ANSWER THEM!

                              You don't have to talk to them, and if you refuse to answer security questions then they shouldn't talk to you. Just refuse to answer security questions, hang up the phone, and then get a notebook/piece of paper (or even update this thread!), and make a note of the date/time they call you.

                              If you refuse to answer security questions, you stay in control and they cannot intimidate you.

                                Hi SnV,

                                Sorry to be such a pain! you have been truly fantastic!

                                I am just a little confused and you guessed extremely stressed. I understand what we are doing with LS as they have been totally irresponsible and I completely understand which angle you are coming from with the LS complaint. However on the P2P I just want to reduce the payment, should I not advise them of the position I am in?
