    Hi Cookie,
    Try not to worry about these templated debt letters. Natwest are in the wrong, they're in default of your SAR request. Be guided by Niddy and you'll be fine.

      Hi, thank you for your message, I have received a Notice of Debt Collection saying they have been instructed by their client to collect the outstanding balance etc and asking for payment in full or for me to telephone them. Up to now the only thing I have received back from Natwest following the SAR letter is a response to a letter I had written previously which they took as a complaint, they responded saying they had investigated and they have done nothing wrong etc etc and enclosed some copies of letters that I had sent to them and some they had sent to me - but I did not receive what would be years worth of statements so that I can see exactly what happened and until I get that I am in no position to argue with them but now they are threatening legal action and I don't want to end up with a CCJ.

        Dcas often threaten legal action as one of the options open to them, it doesn't mean that they're going to go ahead with it. It's usually just scare tactics...and it's working.

        In your first post you said that you'd had a letter threatening legal action. That was almost 6 months ago. Has it happened? No!

        As Elsa says, be guided by Niddy.

          It's Wescot - I will look at the other links now and try and get something in the post asap.

            I've got rid of Westcot (aka Wetcloths) a few times. I bet the letter was on paper with a big red header. I don't think you've any need to worry...it's just meant to scare you.

              Thank you - Yes big red heading and yes it did scare me a bit! Not sure if I should be writing to them too or just the letters to Natwest, what did you do to get rid of them?

                I ignored the letter where they just said pay up but the newly received debt collection letter says I have 7 days to pay up - should I be writing to them too or just Natwest....sorry, it's just a bit confusing what to do for the best.

                  I would write a one liner to Westcot telling them that Natwest are in default of your SAR request and so they should not be chasing you for payment.

                    Thank you - I will send a letter to Westcot today, still not sure which of the other letters to send though as I keep getting the impression they are not 'quite right' for me but I don't know how to make them right......very confused!

                      Sorry, I don't think I responded properly to your message as should've replied directly, this is what has happened:

                        Ok just read the thread. Can you please answer the following and don't do anything till I come back to you;

                        1. Have natwest responded to the SAR & sent statements etc?
                        2. Which dca is chasing you for this debt, please name them?
                        3. You won't get a CCJ. Don't worry. Is this the only debt and the debt is in principle, charges, from what you remember?
                        4. What type of account was this? Credit card/Bank Acct/Loan..?

                          Sorry pc has been broken and I couldn't access the site from work! Thank you for your message, to answer your questions:

                          1. No they have not yet sent copies of statements etc, all I have recieved is copies of some letters I sent to them over the last year or so and their replies.
                          2. The latest letters have come from Wescot
                          3. I geniunely believe this debt is basically from charges applied and then the extra charges for not being within the agreed overdraft, because of the charges
                          4. It was a current account, many years ago there was a credit card but I had a letter saying they couldn't find any details of it to send to me following my SAR

                          Since receiving the first letter from Wescot giving me 7 days to settle, I wrote back to them as suggested by Pixie saying that Natwest were in default of my SAR and that chasing me for the money was therefore inappropriate. I received a second letter saying as they had not heard from me I had 10 days to repay or make contact or further collection activity will be taken. I then received a 3rd letter yesterday stating that in an attempt to avoid further action their client has agreed they can offer a discount to settle, again giving me until 10th Nov (letter dated 31 Oct and recieved 4 Nov). I have not yet responded to these nor have a written to Natwest as I wasn't sure what to say and didn't want to make things worse!

                            As they have not yet responded to your SAR. Was this sent recorded delivery? Have you got a receipt of delivery? If so, you are currently bulletproof. If no receipt of delivery, have they sent any form of acknowledgement?

                              Woah - a SAR doesn't stop anything sadly mate. A s.78 gives protection but not a s.7 DPA request sadly.

                              Ok send the first part of this to Wetcloths. Nothing needs to go to Natwest at the present time and likewise you do not need to to pay £1 for the OD cca request below.

                                I have received a few letters about the SAR, a few from departments saying they couldn't find anything, one saying as I had digitally signed the letter they were unable to confirm I was who I said I was so to sign and return the enclosed form, which I did in June, and then they sent a letter recorded delivery with some printed personal details and the copies of the letters I have sent to them and their replies.
