    Its probably them rectifying the original one, which they seem to do a lot now. So long as the original default date is the same as the time the account was defaulted, then its only one DN. For instance, if the original one shows a default date of 10th June 2008 then this should also match your credit file record. If the new DN shows a new date now, of say 10th March 2011, this would be wrong.

    So you need to check against the credit agency really, but right now i'd not worry about the defaults, if anything keep the proof (ie letters) and then at a later date, look to fight it.

      Received a letter from Marbles, basically a summary that they had recently issued a default notice and now I have breached the CCA (I have? More like you have!) and they demand the return of all cards as the agreement has now been terminated and the cards are their property!.

      They instruct me to contact them with payment proposals within 7 days or further details of the default will be registered with the CRA and legal proceedings may be taken without further notice. It hasn't even been passed to a DCA yet, and they may go down the legal route. Jokers.
      The other brilliant bit is the letter is dated 11 April, I receive it on the 16 April and I have 7 days from the date of the letter to contact them. Doesn't leave a lot of time, does it?!!

      File this away and ignore the a$$holes I presume?

          The omnipresent Mercers have delightfully written to me on behalf of Barclaycard Visa telling me the account is overdue and due to being unable to contact me, they are instructing a local debt collector to visit me at home to collect payment.

          Do I send Mercers the Threat of Doorstep Visit letter if they're instructing a 3rd party to come round?

                Have tried - unsuccessfully - to get the Threat-of-doorstep-visit letter delivered to Mercers. The address of Mercers Ltd on the letter they sent was PO Box 55, L32 8XX, Liverpool.
                However, after 8 days and no delivery confirmation, Royal Mail confirmed that this address doesn't appear on their system.
                Another address that appears on the web for them is Citypoint, 1 Ropemaker Street, London EC2Y 9SS.

                Would it be preferable to try this other address or send to Barclays? Does anyone have an address they have replied to Mercers with? I'd like to get the letter off as soon as possible having waited 8 days for a letter to not arrive at an address that apparently doesn't exist

                  Have the same address as yourself from 18/2/11 have just googled mercers it gives the london address but the status of the company says non trading.

                      This is what I found - but the Liverpool address doesn't seem to exist even though they put the address on the threat letter. I either send to the London address or to Barclays. Or wait until the 'local dect collectors' contact me and send to them

                        Just leave it and wait and see what happens, if they happen to send someone then request details of the dca (they have to supply this to you upon request) and then say thanks and close the door!

                        Remember they have no powers of entry or anything, if they put their foot in your door warn them to remove it before you get a knife and stab their foot as it is trespass.....

                        I doubt they'd be that ignorant of the law anyway, you'll be fine!

                          Mercers have now passed on the B/Card Goldfish account to a new DCA - resolvecall - who are chasing the debt. It's a last chance saloon deal, "they're still happy to discuss an arrangement" otherwise failure to make contact may lead to personal visits and they may commence legal proceedings.

                          I suppose now is the time to fire off the previously mentioned Letter Previously Confirming No CCA? I would think the other B/Card account is being passed from Mercers any time now.

                          And Marbles have finally passed the account onto 1st Credit. All quiet for a while, then all these jabroni's start calling and writing again, making life less enjoyable

                            Ok, this is why I need people; and ask all the time, to quote the original updated post with your timeline as I cannot recall each and every diary (see how many threads i'm trying to keep on top of...?) therefore I politely ask everyone not to presume i'll remember their cases, ie in your case I need to now spend an hour reading the whole thread as i'm more confused than ever now!

                            Ignore all my previous stuff from today and let me get to grips with things here - If I previously said to send XX template then why would you post back with an update, if you'd not already done what I asked? Basically if you have a letter saying they cannot find the agreement then I always say what to do, "if you get hassle by them selling the account you copy that letter and send with a copy of this: ---> CCA Query - Letter Previously Confirming No CCA "

                              Ok, so I presume then that you've had a letter from both Marbles and Goldfish (or their appointed DCA's) confirming that they do not have an agreement? if so, then great you simply copy that letter and send with one of these: ---> CCA Query - Letter Previously Confirming No CCA

                              Usually, regardless of whether they send that letter or not, if they make a threat of legal action then you need to send that template off - even if you have the letter confirming no agreement - bear in mind the debt could sell 10 times before the last DCA knew there was no CCA....

                              Basically, send a copy of the letter confirming No CCA with the above template to both, and see what they come back with....

                                Sorry to confuse things NID, I appreciate how many threads you have to update, that's why I try and keep the thread as straight forward as possible.

                                With the update, I was confirming that this was now an appropriate time to send the Confirmation of No CCA. And that I shall send now for Goldfish. Marbles have now passed to a DCA but no demands from them yet. I shall send that to them when the time comes.

                                Next update I shall make things clearer and more precise
