  • Re: benadabec UE Diary

*Update - having seen Niddy's Hoist/Robinson Way thread, I managed to retrieve the ASID letter from the post office before it was sent!

Notice of Pending Legal Action has come today from Howard Cohen for my ex-Barclaycard/MKDP/now Robinson Way/HPH2 account, not SB until January.
Date of letter is 25th June, so the 10 days to reply runs out on the 5th which is Tuesday. Is it worth sending the LBA letter to them first thing Monday to arrive on the 5th?

Is it possible for you to send the LBA by Fax and on Monday fax a copy of the receipt of Posting?
Anything that puts them on the wrong foot!! ( I surmise they have a fax number on their letter!!)

If you do not have a fax have you got a spare, or could you make and then delete an email address so you could send it today? That will give the crafty little darlings a suprise. Also, do you still have the envelope as it will be useful if it came to it to see when it was sent and if it was first or second class.

I could email/fax but Royal Mail do a guaranteed by 1pm the next day service. So it would get there on the day of the deadline, which I'd be happier with

Personally I would date LBA Sunday,
Send fax copy on Sunday (if you can) with Note attached saying Original posted for guaranteed delivery Tuesday.
On Monday send Original by guaranteed delivery for Tuesday !
What matters is serving the LBA on them before Tuesday! Fax will give you a received receipt as well!
Just put yourself in the strongest position. If they proceed make certain its after they have received the LBA

Am I OK using the LBA Response Template or is there a more specific one tailored to the very active HPH2 group?

If you scroll down through your link to the LBA there is an updated version in the last post. Good luck, paying for recorded delivery should be fine.

Sorry for my ignorance, does the LBA get sent to Robinson Way or directly to Howard Cohen? And does it make any difference that the letter requires that I make acceptable payment proposals in 10 days rather than I contact them within 10 days?

Howard Cohen have passed back to Robinson Way, who have written to ask for £1 to enable Barclaycard to respond to my request. Sounds like I need to send a new CCA request with the payment. Though bear in mind RW told me in December that BC had sent me everything to fulfil their obligations. Round and round we go....
